Sora 2 Is Gone, but Its Legal Risks Remain: What Artists Need to Know About AI Video

AI video is not automatically illegal, but realistic synthetic media can create serious copyright, likeness, privacy, defamation, trademark, and fraud risks. Here is how artists and creators can publish more safely.

Yes—AI video can be risky, but the risk comes mainly from what you generate, whose identity or work it uses, and how you publish it. A clearly fictional clip made with authorized assets is very different from a realistic video of a real person making a false statement, a synthetic advertisement using a famous character, or fabricated footage presented as news.

Sora 2 is now a historical case study rather than a current service: OpenAI says the Sora product was discontinued on April 26, 2026. Its launch still illustrates the legal and creative questions facing artists, marketers, filmmakers, educators, and small businesses using today’s text-to-video, image-to-video, avatar, voice-cloning, and editing tools.

The central warning: the tool does not take responsibility for your publication

In coverage of Sora 2, Yale Privacy Lab founder Sean O’Brien argued that the person or organization using an AI system may bear responsibility for how its output is used. Technology and intellectual-property attorney Richard Santalesa likewise described the conflict between generative tools and existing copyright, publicity, and derivative-work rules.

That is a risk-management principle, not a universal legal ruling. Liability depends on the facts, jurisdiction, the material involved, and the way the video is distributed. But “the AI made it” is not a reliable defense. The person who chooses the prompt, supplies source material, approves the result, adds a caption, and publishes it may be the party facing the complaint.

For artists, the practical rule is simple: if a reasonable viewer could mistake the video for real, or if it uses a recognizable person, protected character, brand, music, or third-party asset, pause before publishing and obtain permission or legal review.

The source article’s legal commentary should not be read as settled law on copyright, fair use, training data, or AI authorship. Those questions remain fact-specific and continue to develop.

Why Sora 2 became a useful case study

OpenAI announced Sora 2 on September 30, 2025, describing a system capable of generating realistic video with synchronized audio. Its launch raised familiar synthetic-media problems: how to control a person’s likeness, prevent deceptive impersonation, identify generated footage, and moderate content that becomes harmful only in context.

OpenAI described safeguards including visible watermarks, invisible provenance signals, C2PA metadata, consent-based likeness controls, prompt and output moderation, reporting, account penalties, and human review. It also acknowledged that technical safeguards cannot solve every contextual risk. A harmless fictional scene can become deceptive when paired with a false caption or presented as authentic footage.

These details refer to Sora 2’s 2025–2026 launch period, not a service readers can currently sign up for. OpenAI’s current notice says the Sora product was no longer available as of April 26, 2026. The underlying risks apply broadly to other AI-video systems, but their terms, safeguards, data practices, and commercial-use rules must be checked separately.

Five separate risk categories

1. Likeness, voice, and publicity rights

A recognizable person does not become free source material merely because an AI tool can imitate them. Risk is especially high when a generated person appears to endorse a product, confess to wrongdoing, make a political statement, participate in sexual conduct, or behave in a way that could damage their reputation.

Consider consent separately for:

  • capturing or uploading the person’s image or voice;
  • generating a new performance;
  • publishing the result;
  • commercial use;
  • remixing or allowing third parties to reuse it.

Public figures, actors, influencers, politicians, deceased celebrities, private individuals, and employees can raise different legal questions. A platform’s likeness feature or identity check is not a blanket release from the person. OpenAI said Sora 2 was designed to restrict nonconsensual likeness use and provide user control over authorized characters, but those were platform safeguards—not universal legal clearance.

An “AI-generated” label may clarify how the video was made, but it does not automatically cure false endorsement, reputational harm, privacy violations, or unauthorized commercial use.

2. Copyright: three different problems

“Is this AI video copyrighted?” is not the same question as “Can I legally publish it?” At least three issues must be separated:

  1. Training data: disputes may concern whether a provider lawfully obtained or used existing works to train a model.
  2. Output similarity: a result may be substantially similar to a protected film, character, song, illustration, or other work.
  3. User inputs: the user may upload footage, music, images, scripts, logos, or client material without having permission to use them.

Purely machine-generated expression may not receive exclusive copyright protection in every jurisdiction or circumstance. Human contributions can matter, including original scripting, storyboarding, shot selection, editing, compositing, sequencing, visual effects, sound design, and substantial post-production.

But copyright ownership and infringement are different questions. An output may be difficult to copyright while still creating liability if it copies protected material or misuses someone’s identity. A user who owns copyright in their editing and arrangement does not automatically acquire rights to another creator’s character, music, footage, or logo.

Do not treat “public domain” as a catch-all answer. Copyright may be absent for one element while trademark, publicity, privacy, contract, or defamation rights remain.

3. Trademarks and false endorsement

A synthetic video can create trademark problems even when its copyright status is uncertain. Examples include a celebrity apparently endorsing a product, a brand mascot appearing in an unauthorized advertisement, a logo placed in fabricated news footage, or a competitor’s mark shown in a defamatory context.

Commercial context increases the need for review. A platform allowing a prompt does not mean the resulting use is licensed by the brand or person depicted.

4. Defamation, misinformation, and fraud

The legal danger rises when a realistic video could be understood as making a factual claim about a real person or event. High-risk examples include synthetic footage showing someone:

  • committing a crime;
  • making a controversial statement;
  • engaging in sexual conduct;
  • endorsing a product;
  • participating in political activity;
  • behaving abusively, dishonestly, or incompetently.

The same technology can support fake executive announcements, fabricated customer testimonials, false emergency footage, political impersonation, or voice-and-video scams. OpenAI’s Sora policies prohibited misleading impersonation, fraud, scams, and content intended to deceive, but a platform policy violation is separate from whether the conduct also violates civil or criminal law.

5. Privacy and confidential data

Before uploading an image, video, voice recording, client brief, or unfinished painting, find out what the service does with it. Check retention, access, model-improvement settings, deletion controls, geographic processing, and whether consumer and enterprise terms differ.

Do not upload confidential business information, unreleased client work, personal data, private messages, or identifiable material involving children unless your contracts, privacy obligations, and the provider’s terms clearly permit it. Sora’s historical feed documentation said recommendations could use activity, engagement, approximate IP-based location, safety signals, and potentially ChatGPT history, with a control to turn that history use off. Those details were product-specific and historical, not a description of current settings for every AI-video service.

Nonconsensual intimate imagery requires a hard stop

Do not generate or redistribute sexualized or intimate synthetic imagery of an identifiable person, former partner, classmate, coworker, minor, or apparent minor. Fictionalization or age progression does not necessarily remove the harm or legal risk when the person remains recognizable.

OpenAI identified nonconsensual intimate imagery, sexual content, and exploitation or sexualization of minors as prohibited or high-risk areas. If such material involves a minor, threats, extortion, fraud, or impersonation, do not forward it for “evidence” or experimentation. Preserve relevant information safely and seek immediate professional or law-enforcement guidance as appropriate.

Why watermarks and C2PA do not make a video safe

Provenance tools are useful, but they answer a narrower question than many viewers assume.

  • Watermarks can help identify generated content, but may be cropped, obscured, or removed.
  • Metadata can be stripped during editing, re-encoding, or reposting.
  • C2PA can help record origin and editing history, but does not prove that the depicted event happened, that the content is lawful, or that every asset was authorized.
  • Detection tools may identify a generation source without determining whether the video is defamatory, infringing, or misleading.

OpenAI described visible and invisible provenance signals, C2PA metadata, internal detection tools, reporting, and human review for Sora 2. Those measures could reduce risk, but they could not replace a human decision about context and publication.

Keep provenance intact where possible. Do not remove a required watermark. More importantly, disclose synthetic content prominently when realism could confuse the audience. A disclosure hidden in metadata is not enough for a video presented as news, documentary evidence, a customer testimonial, or a real event.

  • unauthorized use of a person’s face or voice;
  • false endorsement;
  • copyright infringement;
  • trademark confusion;
  • defamation;
  • privacy violations;
  • breach of a contract or client restriction;
  • fraudulent or deceptive advertising.

Parody and satire may receive protection in some circumstances, and news or public-interest uses can change the analysis. Neither label provides automatic immunity. Presentation, audience, commercial purpose, degree of copying, likelihood of confusion, and the factual implication of the video all matter.

A practical risk matrix

Risk level Typical example Recommended approach
Lower, but not zero A clearly fictional scene with no recognizable person, brand, protected character, or third-party asset. Use authorized inputs, disclose synthetic media where realism could confuse, and retain project records.
Medium Marketing content, historical recreation, branded setting, client-owned material, AI actor, or satire involving a public figure. Obtain releases and permissions, check commercial-use terms, verify factual implications, preserve provenance, and conduct a rights review.
High A fake endorsement, political statement, confession, crime, emergency, sexual image, famous character, song, logo, or celebrity likeness. Do not publish without documented permissions and specialist legal advice. In many cases, do not generate it at all.

Checklist before generating

  • Obtain written permission for recognizable people, voices, logos, footage, music, and commissioned material.
  • Confirm that your agreement covers generation, publication, commercial use, remixing, and third-party access—not merely the original recording.
  • Check the tool’s current terms for commercial use, prohibited content, indemnity, retention, and model-improvement practices.
  • Do not ask a real person to make a factual statement, endorsement, confession, or political claim unless you have clear authorization and an appropriate disclosure.
  • Treat living artists’ distinctive styles, famous characters, brands, and fictional worlds as high-risk inputs.
  • Use enterprise controls or a separately approved workflow for confidential or client-sensitive material.

Checklist before publishing

  • Verify every factual implication, especially captions, voiceover, headlines, and thumbnails.
  • Ask whether a reasonable viewer could mistake the scene for real footage or a genuine statement.
  • Add a clear, prominent disclosure when synthetic media could create confusion.
  • Preserve C2PA or other provenance metadata where available.
  • Keep required watermarks visible.
  • Obtain releases for people, locations, products, music, and client assets where appropriate.
  • Review copyright, trademark, publicity, privacy, defamation, and advertising issues for commercial or high-reach work.
  • Keep prompts, source assets, permissions, edits, dates, model and plan details, disclosures, and takedown correspondence.

If someone challenges the video

  1. Pause distribution while you investigate.
  2. Preserve the original project, source files, metadata, permissions, and edit history.
  3. Do not assume that the provider’s approval or the phrase “the AI made it” resolves the complaint.
  4. Use the provider’s reporting, takedown, or dispute channel.
  5. For commercial, high-reach, defamatory, privacy-sensitive, or intellectual-property disputes, contact a lawyer experienced in media, intellectual property, privacy, or advertising law.
  6. If the complaint concerns a minor, intimate imagery, threats, fraud, or impersonation, do not redistribute the material.

What this means for current AI-video tools

Sora 2’s discontinuation does not eliminate the underlying problem. Adobe Firefly, Google Veo, Runway, avatar services, image-to-video tools, and future systems may offer different workflows and safeguards, but none should be assumed to provide universal rights clearance.

When comparing tools, look for clear commercial-use terms, understandable data-handling rules, provenance support, enterprise controls, reporting procedures, and any provider indemnity. Read the exclusions carefully. A commercial-use claim may address the provider’s license to its own service while leaving you responsible for your prompt, uploaded material, likenesses, music, brands, or resulting publication.

Official starting points include Adobe Firefly, Google Veo, and Runway. Their availability, pricing, terms, and safeguards can change and should be checked directly before use.

Bottom line

AI video is not automatically illegal, and a clearly fictional, properly disclosed clip made from authorized material may be a reasonable creative tool. The risk becomes serious when the video uses a recognizable person, protected creative property, brand, music, confidential data, or a fabricated real-world event.

Use permission, disclosure, provenance, careful source-asset review, and human approval as the minimum workflow. The platform may filter some prompts, but the responsibility for what you choose to publish remains a practical concern for the creator, client, employer, or organization behind the publication.
