Adobe’s 2024 Photoshop Terms of Use controversy was caused by broad, alarming language—not by an announcement that Adobe owned creators’ work or was training Firefly on every Photoshop file. Adobe later clarified the policy and published newer terms effective October 3, 2025. The current rules still allow operational processing of cloud content, but distinguish that access from ownership and prohibit generative-AI training on ordinary local or cloud content, subject to specific exceptions.
Adobe’s June 2024 Photoshop Terms of Use controversy was real, but the most alarming interpretation was not accurate. Adobe did not say it owned ordinary Photoshop users’ work or that it had trained Firefly on those files. The company’s revised wording alarmed creators because it required customers to accept broad language describing automated and human access to content, along with a wide license to operate and improve Adobe services.
Adobe clarified the policy on June 6, 2024, promised a rewrite on June 10, and published newer General Terms of Use effective October 3, 2025. Those current terms make several distinctions that matter to artists: local files are treated differently from cloud-stored files; Adobe retains no ownership of customer content; optional content analytics can be declined; and Adobe says it will not use ordinary local or cloud content to train generative-AI models.

That does not mean Adobe can never process a file. Cloud features require technical access, cloud material may be screened for illegal or abusive content, and limited human review remains possible in specified situations. For professional painters, photographers, illustrators, and designers, the practical question is therefore not simply “Can Adobe see my files?” It is: Which files are stored in Adobe’s cloud, which optional programs are enabled, and does my client or employer permit that arrangement?
Why Photoshop users were alarmed in June 2024
In early June 2024, Adobe asked Creative Cloud and Document Cloud customers—including Photoshop users—to accept updated Terms of Use before continuing to use the applications. The wording referred to Adobe accessing content through automated and manual methods and granted Adobe a broad license that used familiar copyright-style terms such as copying, modifying, displaying, distributing, and sublicensing content.
That language created two separate fears. First, professional creators worried that Adobe was claiming rights in their work. Second, they worried that customer files could be inspected or used in the development of generative-AI systems. Those concerns were especially serious for work containing unreleased artwork, paid client materials, copyrighted source assets, or information protected by a nondisclosure agreement.

A cloud provider generally needs permission to make server copies, cache files, generate previews, synchronize data, or deliver a file to people whom the customer has authorized. The problem was that Adobe’s wording did not clearly explain those limits at the moment users were being required to accept it. To many creators, the legal language appeared much broader than the ordinary technical functions they expected from Photoshop.
What Adobe said in response
On June 6, Adobe said the update was intended to clarify how it moderates content and operates its services. The company said it needed a limited license to access content for purposes including operating or improving services, enforcing its terms, and complying with the law.
Adobe identified examples such as Photoshop Neural Filters, Remove Background, cloud storage, and screening material hosted on its servers for illegal or abusive content. It also stated that it did not train Firefly generative-AI models on customer content and did not claim ownership of customer work.
On June 10, Adobe announced a more extensive rewrite planned for June 18. The company said the new wording would make four points clearer:

- Customer content would not be used to train Adobe’s generative-AI tools.
- Users could opt out of desktop product-improvement programs.
- The licenses required to operate or improve Adobe services would be narrowed and explained with plain-English examples.
Adobe also said that local computer content was not scanned and that human review was limited to situations such as a customer requesting support, public-facing content, or legal compliance. The response was both a policy clarification and an attempt to repair trust: Adobe acknowledged that its Terms of Use should have explained the limits directly instead of leaving users to reconcile sweeping legal language with separate public assurances.
What the current Adobe terms say
Adobe’s currently published General Terms of Use are marked “Published October 3, 2025” and “Effective as of October 3, 2025.” They replace earlier versions. The summaries on Adobe’s page are useful explanations, but Adobe states that the complete terms—not the summary—are the binding text. Read the current Adobe General Terms of Use before relying on any summary, particularly for commercial or client work.
1. You keep ownership of your content
The current terms say that customers retain their rights and ownership in content they provide to Adobe. Adobe says it does not claim ownership of that content.
That ownership statement is separate from the operational license. If you save a painting in an Adobe cloud service, Adobe may need to copy it to servers, cache it, compress it, create a thumbnail, synchronize it between devices, or make it available to collaborators at your direction. Those acts can technically involve reproducing or displaying the file, even though Adobe does not become the copyright owner.
The terms describe this as a non-exclusive, worldwide, royalty-free license for the operations needed to provide the services. They also say Adobe cannot grant a sublicense broader than the rights granted by the customer. In practical terms, this is the distinction creators needed Adobe to state more clearly in 2024: permission to operate a cloud service is not the same thing as ownership of the underlying artwork.
2. Local files and cloud files are not treated the same way
The most important practical distinction is where the file resides.

Features that rely on cloud processing can require access even when the user is not manually sending a file to a person. Generating a preview, syncing a document, applying a cloud-based effect, or returning an AI-assisted result may require automated handling on Adobe’s servers.

Does Adobe use Photoshop files to train Firefly?
Under the current terms, Adobe says it will not use local or cloud content to train generative-AI models, with two important qualifications:

- Customer-requested custom models: The terms describe an exception when a customer specifically asks Adobe to train a custom model on that customer’s content.
Therefore, it would be inaccurate to say that Adobe trains Firefly on ordinary Photoshop files simply because those files are stored in Creative Cloud. It is also too strong to say that no Adobe system can ever process content for any AI-related purpose. The relevant questions are whether the content was submitted to Adobe Stock, whether the customer requested a custom model, and which product-specific terms apply.
What is optional content analytics?
The current terms separately describe optional content analytics. When enabled, Adobe may analyze characteristics of cloud content and usage to improve services, provide recommendations, or customize the experience. Adobe says users have opt-out rights for this activity.
The improvement provision permits internal analysis and limited use by vendors working on Adobe’s behalf, subject to confidentiality and privacy restrictions. Adobe says it will not publicly display the content or allow third parties to use that clause to improve their own products.
This is different from the basic technical license required to provide cloud functionality. Declining optional analytics does not necessarily turn off every operation needed to store, synchronize, preview, or deliver a cloud file. It is a way to limit a separate category of analysis—not a guarantee that a cloud service will never process the file.
What professional creators should do
- Identify the storage location. Check whether a Photoshop document is saved only to a local drive or is being uploaded, synchronized, or shared through Creative Cloud.
- Review optional privacy and improvement controls. If you do not want optional content analytics or desktop product-improvement participation, review the relevant Adobe account and application settings and opt out where available.
- Check client and employer agreements. A contract may restrict uploading work to third-party cloud services even when the provider promises not to claim ownership or train AI models on it.
- Separate sensitive projects. Keep confidential drafts, unreleased commissioned work, personal identity documents, and material covered by an NDA in a workflow approved for that type of data.
- Read product-specific terms. Creative Cloud, Adobe Stock, collaboration features, and custom AI services may have additional rules. Do not assume that a general Photoshop workflow answers every question about Adobe Stock or another product.
- Keep independent backups. A local or separately managed backup protects against account problems, synchronization mistakes, or loss of access. It does not alter Adobe’s terms, but it reduces dependence on one cloud account.
These are workflow precautions, not a legal conclusion. If a project involves valuable intellectual property, regulated information, or strict confidentiality obligations, ask the client, employer, or qualified legal adviser what storage and processing arrangements are permitted.
The trust issue has not disappeared
Adobe’s later terms are more precise than the language that triggered the June 2024 backlash. They distinguish ownership from operational access, local storage from cloud storage, optional analytics from required service functions, and ordinary customer content from Adobe Stock submissions or customer-requested custom-model training.
Those distinctions matter, but they do not eliminate the underlying trust question. A creator still has to understand where a file is stored and what permissions have been enabled. Adobe can access cloud content for defined operational, safety, support, legal, or opted-in improvement purposes; the accurate claim is not that Adobe can never see a file.
The fairest summary is this: Adobe responded to the Photoshop Terms of Use outrage by narrowing and explaining its position, and its current terms say Adobe does not own ordinary customer work or use it to train generative-AI models. But cloud-stored content remains subject to technical processing and limited review, so creators should make storage and opt-in decisions based on the confidentiality requirements of each project.

Bottom line: Adobe’s June 2024 Terms of Use wording caused legitimate concern because it described broad access and licensing in language that sounded detached from ordinary Photoshop operations. Adobe’s current terms, effective October 3, 2025, say customers retain ownership, ordinary local and cloud content is not used to train generative-AI models, and optional content analytics can be declined. However, Adobe can still technically process cloud files and conduct limited review in specified circumstances. Keep sensitive work in a storage arrangement approved by the client or employer, and distinguish local files from Creative Cloud content before accepting the terms.
