What Legal Safety Means For AI Music

There are two separate questions: whether you have permission under a service’s terms to use a track, and whether copyright law protects the track or parts of it. A commercial license answers the first only within its stated scope; it does not guarantee copyright ownership, prevent a third party from making a similar track, or resolve rights in material you supplied.

In its January 29, 2025 report, the U.S. Copyright Office said that material generated entirely by AI is not copyrightable, prompts alone do not make someone the author, and human-authored parts of a mixed work may be protected. For a registration application containing more than a minimal amount of AI-generated material, applicants must disclose it and describe the human author’s contribution. These are the commercial-use statements and limits established for the products below. They are not a guarantee that a track is free of every possible claim. Use A Rights-Aware Music Workflow

1. Define the use before generating. Write down whether the music will sit under a video, ship inside a game, appear in an ad, or be released as a standalone track. Check that exact use against the plan’s terms; a service’s general commercial-use phrase may not answer every case.
2. Prompt for musical qualities, not someone else’s identity. For example: “Create an original 30-second instrumental cue for a digital painting time-lapse, with a steady mid-tempo pulse, warm synth pads, and a clear ending. No vocals, samples, or references to a specific artist or song.” This describes arrangement and mood without asking for imitation.
3. Get permission for material you contribute. Use a voice only with the speaker’s consent and check the service’s terms for voice use. For covers, uploaded recordings, samples, lyrics, and reference audio, confirm you have the necessary rights and permissions before submitting or publishing them. A tool’s commercial license does not establish permission for material you supplied.
4. Keep evidence together. Save the prompt, generated file, download date, plan and applicable terms, license certificate if offered, and notes about lyrics, edits, performances, or other human-authored contributions. If you later seek U.S. copyright registration for a mixed work, disclose more than minimal AI-generated material and describe the human contribution.
5. Check the destination platform separately. Spotify announced that vocal impersonation is allowed only with authorization from the impersonated artist, and that it supports DDEX AI disclosures in credits. YouTube requires disclosure for realistic altered or synthetic content that could be mistaken for a real person’s performance. Read the current platform rules before release. 6. Make uploads distinct and purposeful. YouTube’s inauthentic-content policy targets mass-produced, repetitive, or template-based uploads; it does not target AI use as such.
