“The platform says I own it” and “I own the copyright” are different claims. A service may give you permission to use a generated track commercially, or say the track belongs to you under its terms, without that establishing that the track qualifies for copyright protection. For a digital creator, check both questions before using AI music in a paid video, game, stream, or client project.
What Does Ownership Mean For AI Music?
Ownership can refer to contractual control: what a platform lets you download, publish, adapt, or monetize under its terms. Copyright is a separate question about legal protection and who authored the work. A commercial-use license can help you use a track in a project, but it does not by itself prove that you hold copyright in the generated music.
In its January 29, 2025 report on AI, the U.S. Copyright Office said that music generated entirely by AI is not copyrightable in the United States, and that prompts alone do not make the user the author. In a mixed work, only the human-authored parts may be protected. When registering a work containing more than a minimal amount of AI-generated material, applicants must disclose that material and describe the human author’s contribution. Read the wording as a description of the platform’s own terms, not as a universal copyright ruling. “Commercial use,” “royalty-free,” “licensed,” and “yours” can describe different permissions or contractual arrangements. Check the terms that apply to the plan you used and the date you generated the track. The available claims differ across services:

How To Make Your Contribution Clear
If you want to preserve the parts you actually authored, keep a simple project record as you work. This does not guarantee copyright protection, but it helps distinguish your contribution from generated material and supports an accurate account of how the track was made.
- Save your original lyrics, melody, or other musical material before entering prompts.
- Keep drafts that show your own edits to lyrics, melody, arrangement, or recorded performance.
- Save the generated version, later edits, stems, and the platform terms or license that applied when you generated and downloaded it.
- When describing or registering the work, distinguish the human-authored material from AI-generated material. For U.S. registration, disclose more than minimal AI-generated material and describe the human contribution.
Voices, Covers, Samples, And Uploads
Using a platform’s generator does not establish that you have permission to use a real person’s voice, a cover, or an uploaded sample. Get the relevant consent or rights before using those elements, and check the platform’s terms for both the source material and the generated result. For Spotify distribution, Spotify says vocal impersonation is allowed only when the impersonated artist has authorized it. A Practical Check Before You Publish
- Identify the project: personal, monetized, client work, advertising, film, TV, game, or streaming release.
- Find the license for the plan and generation date, then confirm it permits that specific use and the download or distribution you need.
- Check that any voice, sample, cover, or reference audio was used with appropriate consent and under the platform’s terms.
- Keep your human-authored drafts and edits separate from generated material, and follow any disclosure rules for the platform where you publish.
If a product page does not clearly establish the permission you need, check the vendor’s current terms before publishing. A “commercial” claim is not a substitute for checking the particular project, plan, and source material.
