The decisive differences are the number of principal units, how they are arranged, whether they share a lot or common property, and the land-use category in the local zoning bylaw.

That means a duplex can be a type of multi-unit development in ordinary conversation, yet be regulated under a separate duplex, dual-occupancy, semi-detached, townhouse or multiplex definition in a particular city. Always identify the jurisdiction before relying on a formal definition.
The short answer: “duplex” is specific; “multi-unit” is a moving category
In its ordinary property meaning, a duplex has two self-contained dwellings in one development. Each unit normally has its own living, sleeping, cooking and bathroom facilities, although the exact physical and legal requirements are set by local rules. A multi-unit development may contain two units or several more, depending on the authority using the term. In other bylaws, “multi-unit” starts at three units and excludes a duplex from that particular category.
Do not treat the words as a universal construction classification. A side-by-side pair may be called a semi-detached or townhouse development; two homes on one lot may be called a dual occupancy; and two units arranged one above the other may meet a city’s duplex definition. The same building can therefore receive different labels in different jurisdictions.
What a duplex means in different jurisdictions
Toronto: a two-to-four-unit multiplex, with an arrangement requirement
The City of Toronto’s multiplex guidance describes a multiplex as a residential building with two, three or four units, also called a duplex, triplex or fourplex under its zoning bylaw. The guidance requires at least one unit to be wholly or partly above another. Units that are entirely side by side are generally treated as townhouse or semi-detached housing instead. In Toronto, “duplex” therefore describes both a two-unit outcome and a particular vertical relationship between units.
Edmonton: two principal dwellings, one over the other
Edmonton’s zoning definition is narrower in physical form. “Duplex Housing” means a building where one principal dwelling is placed over another principal dwelling, in whole or in part, within a single building, with separate and individual access. The definition excludes semi-detached housing. A pair of homes sharing a wall but sitting side by side may consequently fall into another Edmonton category even though an agent or builder informally calls it a duplex.

Ottawa: horizontal division for a duplex
The cited Ottawa Zoning By-law 2026-50 page defines a duplex dwelling as two principal units divided horizontally. The same page defines a townhouse dwelling as three or more attached units divided vertically, and a stacked dwelling as four or more principal units divided both horizontally and vertically in a building no more than four storeys high. These definitions show why “stacked,” “townhouse” and “duplex” cannot be substituted without checking the local text.
Brisbane: dual occupancy can be attached or detached
Brisbane City Council uses “dual occupancy” for duplex developments in Brisbane City Plan 2014. The term covers two dwellings on one lot, whether attached or not, and can also cover two dwellings on separate lots that share common property. Brisbane therefore focuses on the two-dwelling development and its land relationship rather than requiring a single stacked arrangement.

San Diego’s zoning definitions describe a duplex as two dwelling units. A multi-dwelling structure is defined as three or more units in any vertical or horizontal arrangement. Under that code, a duplex is not a multi-dwelling structure, even though both are multi-unit in everyday language.
What counts as a multi-unit development?
There is no single unit-count threshold that applies everywhere. The cited examples illustrate three different approaches:
- Toronto places two-, three- and four-unit buildings in its multiplex category and separately describes an apartment building as seven or more units under the cited zoning provisions.
- San Diego uses three or more units for a multi-dwelling structure, regardless of whether the units are stacked or side by side.
- Other municipalities may use “multi-unit” as an umbrella phrase for any building containing more than one dwelling, which can include a duplex.
These are legal category boundaries, not market statistics. They do not establish a universal definition for a lender, insurer, tax authority or planning department. A six-unit building may be a multiplex in one city, an apartment building in another, and a separate “multiple dwelling” class elsewhere.

Layout can change the legal category
Unit count alone does not settle the question. The arrangement of the units, the entrances and the relationship to the lot can move a proposal into a different zoning category.

In a stacked arrangement, one dwelling is wholly or partly above another. This is the defining pattern in Edmonton’s duplex definition and part of Toronto’s multiplex guidance. Ottawa also uses horizontal division in its duplex and stacked-dwelling definitions. A stacked design may remain one building on one lot, but the number of units and the building’s height can trigger additional rules.
Side-by-side units
Two homes placed next to each other may be classified as semi-detached, townhouse or another attached-housing form rather than a duplex. Toronto generally treats entirely side-by-side units as townhouse or semi-detached housing, and Edmonton expressly excludes semi-detached housing from its duplex definition. Calling the project a duplex in a listing does not override the bylaw category.
Detached dwellings on one lot
Some planning schemes allow two detached homes on the same parcel under a dual-occupancy or similar category. Brisbane’s dual-occupancy guidance expressly allows the two dwellings to be attached or separate on one lot. A detached configuration can therefore qualify as a two-dwelling development without resembling a conventional duplex building.
Separate lots with shared property
Brisbane also recognizes two dwellings on separate lots that share common property. This arrangement raises title, access, servicing and maintenance questions that do not arise in exactly the same way when both dwellings remain on one lot. The planning label should be checked alongside the proposed subdivision or community-title structure.

Why the distinction matters before you design or buy
Zoning permission
The permitted category determines whether the proposal is allowed on the site, prohibited, or possible only through a discretionary process. A two-unit project that qualifies as a duplex in one zone may be treated as semi-detached housing or a multi-dwelling structure in another. That can change minimum lot dimensions, setbacks, building height, parking, landscaping, access and servicing requirements.
Overlays and mapped areas
Special overlays can limit where a category is available. Toronto’s sixplex overlay has regulations only in the areas shown on its overlay map; it is not a citywide permission. A site outside the mapped area cannot be assumed to receive the same treatment as a site inside it.
Assessment pathway
Brisbane states that a dual-occupancy proposal can be code assessable or impact assessable. Code assessment generally follows the applicable planning code when the proposal meets its requirements; impact assessment involves public notification and a broader assessment of the proposal under the planning scheme. The correct pathway is a site-specific planning question, not a consequence of the word “duplex” alone.
Ownership and future subdivision
Two dwellings in one building may remain under one title, be separately titled later, or share common property under a different ownership structure. Separate lots can introduce easements, driveways, utility corridors and maintenance obligations. Confirm the proposed title arrangement with the local authority and a qualified property professional before treating two units as two independently saleable properties.

More units generally create more interfaces to coordinate: entrances, fire separation, acoustic separation, waste storage, water and drainage connections, vehicle access and common areas. The exact technical requirements come from the applicable building, fire, accessibility and servicing codes, which are separate from the planning definition. A planning approval for the unit count is not, by itself, a building permit.

How to classify a proposed development
- Identify the authority and current rule set. Write down the city, state or province, parcel address and the bylaw or planning scheme currently in force. Municipal definitions can change, and mapped overlays may be updated.
- Count principal dwelling units. Count the independent homes the design proposes, not bedrooms, leases or occupants. Record whether each unit has its own access and the facilities required by the local definition.
- Draw the physical arrangement. Mark which units are above, below or beside one another; whether any unit is partly over another; and whether buildings are attached or detached.
- Map the land relationship. Confirm whether all dwellings sit on one lot, will be subdivided, or will occupy separate lots that share a driveway, accessway or other common property.
- Search the definitions section. Check the exact terms used by the local zoning code: duplex, dual occupancy, semi-detached, townhouse, stacked dwelling, multiplex, multi-dwelling and apartment building may each have separate tests.
- Check the zone and overlays. Verify that the category is listed as permitted, conditional, code assessable or impact assessable in the site’s zone. Review every mapped overlay that applies to the parcel.
- Confirm the approval sequence. Ask the planning authority whether you need a development application, site-plan or zoning review, subdivision approval, building permit, servicing approvals or separate heritage and environmental permits.
- Obtain written confirmation for borderline cases. Where the layout sits between categories, provide a dimensioned site plan and unit diagram and request a written interpretation or pre-application meeting. Keep that response with the project records.
Worked classification examples
Two apartments, one above the other
This is the clearest duplex pattern under Edmonton’s definition because one principal dwelling is placed over another and each has separate access. In Toronto it can fit the two-unit multiplex description. In San Diego it is a duplex, but not a multi-dwelling structure because that category begins at three units.
Two attached homes sharing a wall
The unit count is two, but the classification may be semi-detached or townhouse rather than duplex. Toronto’s guidance generally places entirely side-by-side units in those categories, and Edmonton excludes semi-detached housing from its duplex definition. A site plan review is needed before selecting the application form.
Two detached homes on one Brisbane lot
Brisbane’s dual-occupancy concept can cover this arrangement even though the buildings are not stacked or attached. The proposal still needs the zone, overlay and assessment checks that determine whether it is code assessable or impact assessable.
Quick wins for a faster PC:
Repair Windows errors before they cause bigger problemsFix Now →Scan for outdated or missing drivers - takes under a minuteDriver Scan →Four stacked units in a low-rise building
Toronto may treat the project as a four-unit multiplex. Ottawa’s cited definition uses “stacked dwelling” for four or more principal units divided horizontally and vertically in a building no more than four storeys high. The same physical project could be described under a different category elsewhere.
Eight units in one apartment building
Under the cited Toronto zoning provisions, an apartment-building category begins at seven or more units, subject to the bylaw’s arrangement and entrance requirements. That threshold should not be exported to another city, where eight units may be regulated as multi-dwelling housing, a small apartment, or another class.
Common mistakes and how to avoid them
- Using “multi-unit” as if it had one meaning. State the jurisdiction and quote the local threshold or arrangement test.
- Assuming two side-by-side homes are always a duplex. Check whether the bylaw places them in semi-detached or townhouse housing.
- Counting bedrooms instead of dwellings. A six-bedroom house is not automatically a six-unit development; the question is how many independent principal units are legally created.
- Ignoring the lot structure. Two homes on one lot, two lots with common property and two separately serviced lots can have different approval and title consequences.
- Relying on an old overlay map or bylaw edition. Toronto’s sixplex overlay, for example, applies only to specified mapped areas. Use the current map and consolidated bylaw.
- Treating a planning label as a building approval. Zoning permission does not replace building, fire, accessibility, servicing or subdivision approvals.
- Promising a universal financial result. The cited municipal sources do not establish that duplexes are always cheaper, faster to build, easier to finance or more profitable than larger developments. Those outcomes depend on the site, design, market and approvals.
A practical decision framework for owners and designers
Use four questions before choosing a project name or preparing drawings:
- How many legal homes are proposed? Two points toward a duplex or dual-occupancy discussion; three or more may move the project into a multi-dwelling, multiplex or apartment category.
- How are the homes arranged? Stacked, side-by-side and detached layouts are not interchangeable in many codes.
- What is the land and title strategy? Decide whether the dwellings stay on one lot, are subdivided, or share common property, then test that strategy against local rules.
- Which approval pathway applies to this parcel? Confirm the zone, overlays and assessment route with the authority that regulates the site.
If the answers point to different categories, use the category that the governing bylaw assigns, not the marketing label that sounds most familiar. A planner, surveyor, architect or development consultant can help assemble the unit schedule, site plan and title diagram needed for a formal interpretation.
Bottom line for the comparison
A duplex is normally a two-dwelling development, but its permitted arrangement varies: stacked units are required in some cities, while other schemes allow attached or detached homes. “Multi-unit” is broader in ordinary speech and inconsistent in law. Toronto includes two- to four-unit multiplexes, San Diego starts its multi-dwelling structure at three units, and the cited Toronto apartment-building category starts at seven. Therefore, the reliable way to tell the difference is to compare the local unit count, configuration, lot or common-property arrangement, zoning category and approval pathway. Check the current bylaw and overlay map for the specific parcel before designing, purchasing or advertising the development.
