How High Can a Retaining Wall Be Before It Needs a Permit or Engineering?

Four feet is only a common model-code starting point. Local rules may use a three-foot limit, measure height differently, or require permits and engineering for surcharge, slopes, tiered walls, soils, property lines or critical areas.

There is no nationwide height that guarantees a retaining wall is permit-free or exempt from engineering. Four feet is a common starting point: the 2021 International Residential Code (IRC) exempts some walls no more than four feet high, measured from the bottom of the footing to the top of the wall, unless the wall supports a surcharge. Cities and counties can adopt lower limits, use a different height measurement, or require review because of slopes, tiered walls, nearby structures, property lines, soil conditions or environmentally critical areas.

Permit rules and engineering rules are related but separate. A wall below a local permit threshold can still need a structural design, geotechnical advice or additional approval if it carries a driveway, building, steep backfill or other load. Confirm the adopted code and site-specific requirements with the building or planning department before excavation.

The short answer: start at four feet, then verify the local rule

The 2021 IRC model-code exception is often summarized as “retaining walls four feet or less do not need a permit.” That summary leaves out two important qualifications: the code measures height from the bottom of the footing to the top of the wall, and the exception does not apply when the wall supports a surcharge. The IRC is a model code, not an automatic nationwide law. States, counties and cities may adopt a different edition or amend the exception.

Published rules show why a single national number is unsafe:

  • Portland, Oregon, requires a building permit for a wall more than four feet high, measured from the bottom of the footing to the top, or for any wall supporting a surcharge.
  • San Diego, California, generally requires a permit above three feet, measured from the top of the footing to the highest point, and adds triggers for sloping backfill, surcharge and certain tiered walls.
  • Montgomery County, Maryland, requires a permit above three feet of retained height and for several site conditions regardless of height.
  • Seattle, Washington, allows a no-permit wall at four feet or less only when all of its listed conditions are satisfied, including being outside an environmentally critical area and avoiding damage to adjoining property or structures.

These are jurisdiction-specific examples, not a national survey. Your property may be governed by a state code, a locally amended building code, zoning or grading rules, or more than one approval process.

Why “height” is not one universal measurement

Before comparing your wall with a threshold, identify the measurement method in the rule that applies to your site. A wall can fall below one definition and above another.

Authority or code Height reference Main threshold or condition Additional triggers described by the authority
2021 IRC model-code exception Bottom of footing to top of wall No more than four feet for the stated exception Exception does not apply when the wall supports surcharge
Portland, Oregon Bottom of footing to top of wall Permit required above four feet Permit required at any height when supporting surcharge
San Diego, California (Information Bulletin 220, October 2024) Top of footing to highest point Permit required above three feet Specified steep backfill, surcharge, flammable-liquid impoundment and tiered-wall conditions
Montgomery County, Maryland Retained height; the county also describes measurement from the lowest abutting grade Permit required above three feet retained height Surcharge, lot-line crossing, problem soils and tiered systems
Seattle, Washington Bottom of footing to top of wall No construction permit only at four feet or less when every listed condition is met Must be outside an environmentally critical area and must not damage adjoining property or structures during or after construction

“Retained height” can differ from the visible face of a wall when the footing is buried, grades change, or the ground on either side is uneven. Draw a section through the wall showing existing grade, proposed grade, footing depth and top of wall. Give that drawing to the authority and ask which points it will use.

Permit triggers that can apply below the height limit

Surcharge from driveways, buildings and other loads

Portland defines surcharge as an additional load beyond the ordinary weight of level earth backfill. San Diego specifically identifies driveways, walkways and structure footings as examples. A wall beside a parking area, driveway, building foundation, storage area or heavily used path may therefore require a permit or engineered design even when its measured height is below three or four feet.

  • Perfect for home interiors and DIY painting projects, this 19-piece set keeps essential wall painting supplies together in one convenient kit.

Do not decide for yourself that a load is too small to matter. Tell the building department what is above and behind the wall, how far it is from the wall, and whether vehicles or structures can approach it. The authority may classify that load as surcharge under its local code.

Sloping backfill and steep sites

Level soil behind a wall creates a different pressure pattern from soil that rises steeply away from the wall. San Diego lists specified sloped-backfill conditions as permit triggers and says walls with those conditions are not eligible to use the city’s standard retaining-wall design. A steep lot can also raise slope-stability and drainage questions that are independent of the wall’s face height.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Tiered or stepped walls

Separate short walls are not automatically treated as independent projects. San Diego addresses a combined tiered-wall condition involving more than six feet measured from the top of the bottom-tier footing to the top of the upper-tier wall, or a footing that crosses a lower wall’s slope-stability plane. Montgomery County lists tiering as a permit trigger. Provide a scaled section showing each wall, vertical spacing, horizontal setbacks and the grades between tiers.

Property lines, structures and critical areas

Montgomery County identifies a wall that crosses a lot line as a permit trigger and also lists problem soils. Seattle’s exemption applies only when construction and the completed wall will not damage adjoining property or structures and the site is outside an environmentally critical area. A wall near a neighboring foundation, public right-of-way, steep slope, wetland or mapped hazard area deserves an early jurisdictional review, even if it is short.

When engineering or a geotechnical report is required

A permit exemption is not a certification that a wall is structurally adequate. Engineering requirements may be written in a separate section of the local code, in the permit department’s handout, or in conditions attached to the site.

Structural calculations and stamped drawings

Portland asks for drawings and calculations stamped by an Oregon-registered engineer for walls over four feet. Its guidance also notes that some sites may require a geotechnical report. The design package should address wall stability, footing dimensions, drainage, soil properties, reinforcement or anchorage, and the loads behind the wall as required by the local reviewer.

Montgomery County’s engineering threshold

Montgomery County cites accepted engineering practice for walls over four feet of retained height, or over three feet when resisting surcharge. That wording illustrates why a wall can cross an engineering threshold before it crosses a general height threshold: the retained soil and the load condition both matter.

Why soil and drainage matter

Water pressure, weak or expansive soil, an irregular slope and poor drainage can govern the design. A geotechnical professional may need to characterize the soil, groundwater and global slope stability rather than merely size the wall face. If the authority asks for a report, use the scope and credential it specifies; a generic product drawing is not a substitute for site design.

What the major published examples require

2021 IRC model-code baseline

The 2021 IRC text provides the familiar four-foot exception for retaining walls measured from the bottom of the footing to the top of the wall, unless the wall supports surcharge. Because jurisdictions adopt and amend model codes independently, verify the edition and amendments in force where the property is located.

Portland, Oregon

Portland’s published rule states that a building permit is required when a retaining wall is more than four feet high, measured from the bottom of the footing to the top of the wall, or when it supports a surcharge. For walls over four feet, the city asks for stamped drawings and calculations by an Oregon-registered engineer; some locations may also need a geotechnical report. Portland’s definition of surcharge is an additional load beyond the ordinary weight of level earth backfill.

San Diego, California

Information Bulletin 220, dated October 2024, requires permits above three feet measured from the top of the footing to the highest point. It also lists specified steep backfill, surcharge, certain tiered-wall arrangements and impounded flammable liquids as triggers. The bulletin says walls with the specified sloped-backfill, surcharge or flammable-liquid conditions cannot use the city’s standard retaining-wall design. For tiered walls, the bulletin describes a combined condition exceeding six feet from the bottom-tier footing top to the top-tier wall, or a footing crossing a lower wall’s slope-stability plane.

Montgomery County, Maryland

The county requires a permit above three feet of retained height and when the wall supports surcharge, crosses a lot line, is in problem soils or forms part of a tiered system. It cites 2018 IRC Section R404 for engineering design above four feet retained height, or above three feet when the wall resists surcharge.

Seattle, Washington

Seattle says a construction permit is unnecessary only when all three conditions in its guidance are met: the wall is four feet or lower from the bottom of the footing to the top, the site is outside an environmentally critical area, and the work will not damage adjoining property or structures during or after construction. Missing any one condition removes that narrow exemption.

Oregon statewide context

An Oregon code amendment describes permit requirements for retaining walls that safeguard building users, support accessible parking or regulated buildings, or retain material that could affect a regulated building. It allows municipalities to regulate other retaining walls within the stated limit and exceptions. State rules and local ordinances therefore need to be checked together.

How to determine the rule for your property

  1. Map the location. Record the address, property-line distances, right-of-way, nearby buildings, fences, driveways, parking areas and utilities. Note whether the site is on a steep slope or in an environmentally critical or other regulated area.
  2. Measure the proposed wall. Prepare a section showing footing bottom, footing top, wall top, existing grade, finished grade, retained height and any buried portion. Include the highest point if the wall steps or follows a slope.
  3. Describe the soil and geometry. Show whether backfill is level or sloped, the drainage path, soil or rock conditions you know about, and every tier with its spacing and elevation.
  4. List loads behind the wall. Identify driveways, walkways, building footings, parking, storage, fences, pools and other loads, with their approximate distances from the wall.
  5. Ask the authority targeted questions. Ask which code edition and amendments apply; how it measures height; whether surcharge, tiering, slope or lot-line proximity triggers a permit; and whether separate grading or zoning approval is required.
  6. Confirm design submittals and inspections. Ask whether calculations, stamped plans, an engineer’s license from the relevant state, a geotechnical report, footing inspection, drainage inspection or final inspection is required.
  7. Keep the written answer. Save the department’s webpage, email or counter guidance with the project drawings. Rules and interpretations can change, and a verbal assumption is difficult to document later.

Common project scenarios

A level-backfill garden wall at three feet

It may fall below a four-foot model-code threshold, but a city using a three-foot limit, or a site with a driveway surcharge, tiering or critical-area restriction, can still require a permit. The footing-based measurement may also put it over the local limit if part of the wall is buried.

A four-foot wall beside a driveway

Height alone does not answer the question. The driveway load may be surcharge, which Portland and San Diego identify as a permit trigger. Provide the driveway elevation, distance and expected vehicle loading to the reviewer.

Two walls that are each three feet high

The authority may evaluate the system as a tiered wall. San Diego and Montgomery County both publish tiering conditions that can trigger review. Show the entire stepped arrangement rather than submitting each wall as an isolated project.

A short wall near a neighboring foundation

Seattle’s exemption expressly depends on avoiding damage to adjoining property or structures. Excavation, drainage changes and loss of lateral support can create risk even when the finished wall is low. Ask about property-line setbacks, temporary shoring and inspection requirements before digging.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What to have ready for a permit or engineering review

  • A dimensioned site plan with property lines, structures, access, utilities and wall location.
  • A wall section with both height measurements the local authority might use, footing depth, drainage and backfill slope.
  • Tier elevations and horizontal spacing where walls are stepped.
  • Locations and descriptions of surcharges, including driveways, walkways and structure footings.
  • Known soil, groundwater, slope or environmental constraints.
  • Engineering calculations and stamped drawings when required, plus any geotechnical report requested by the jurisdiction.
  • A proposed construction sequence that protects neighboring property and allows required inspections.

Do not start excavation on the assumption that a height-based exemption covers grading, zoning, drainage, environmental or right-of-way approvals. Ask the authority whether those reviews are separate.

Bottom line for homeowners and contractors

Use four feet only as an initial screening number, not as permission to build. The controlling answer depends on the local code, the way that code measures height, and site conditions such as surcharge, sloping backfill, tiering, nearby structures, lot lines, soils and critical areas. Engineering can be required at a different threshold from the permit, and a permit exemption never removes the obligation to build a stable, properly drained wall that does not harm adjoining property. Assemble a section, site plan and load information, then obtain the building or planning department’s written requirements before construction.
