To avoid a copyright strike, treat an AI track as cleared only after you verify the plan’s license, remove unapproved voice or audio references, keep your creation records, and disclose synthetic elements when a platform asks. A prompt alone does not give you copyright ownership: the U.S. Copyright Office says entirely AI-generated material is not copyrightable, while human-authored parts of a mixed work may be protected. Use A Rights-First Workflow
- Choose the release destination first. Write down whether the track will sit under a YouTube video, a client deliverable, a social post, a podcast, a game, or a streaming release. The destination determines which plan terms and platform disclosures you need to check.
- Start with an original brief. Use musical instructions such as “instrumental electronic underscore, 100 BPM, tense but clean, 45-second loop with a clear ending, no artist imitation, no recognizable melody.” Do not name a living artist, ask for a sound-alike, or paste lyrics you do not control.
- Use only audio you can lawfully upload. Reference audio, samples, stems, lyrics, and vocal recordings need permission from the person who created or performed them. For voice cloning, obtain the speaker’s explicit consent and keep the consent record; a platform’s feature does not replace that permission.
- Check the plan before generating the final file. Save a screenshot or PDF of the pricing and license page, the plan name, date, account, prompt, source files, and export. If a commercial-use term is not stated, ask the vendor before publishing.
- Make a human contribution. Edit arrangement, lyrics, performance, sound design, or mix yourself and retain project files. That gives you a clear record of the human-authored portion if you later register or explain the work.
- Run an identity and similarity check. Reject outputs that imitate a named singer, reproduce a recognizable hook, or contain a copied lyric or sample. Regenerate from a more general brief and remove the reference that caused the problem.
- Prepare platform disclosures. Spotify supports DDEX AI disclosures in credits and says vocal impersonation is allowed only when the impersonated artist authorized it. YouTube requires its altered-or-synthetic content label for realistic synthetic content that could be mistaken for a real person’s performance. - Publish a clean master and your evidence. Keep the licensed export, stems, project file, consent records, prompt history, and plan terms together. If a platform disputes the upload, these records show what you used and what you changed.
Pick A Tool With A Clearer Rights Path
The table separates stated licensing information from gaps you must verify. “Not stated” means the supplied product information does not establish a safe commercial permission.

Build Prompts That Reduce Infringement Risk
For Background Music Under Digital Art
Prompt: “Instrumental ambient pulse for a 30-second digital painting process video, sparse percussion, warm synth pad, gradual lift at 20 seconds, clean ending, no vocals, no artist or song references.” Add the intended duration and edit points yourself. Ask the vendor whether its tool supports a loop or exact duration; the supplied product information does not establish that every tool does.

Write lyrics you authored, then request a fictional vocal character rather than a named singer: “Original lyrics about night driving, low male vocal, restrained delivery, modern pop arrangement, no imitation of any real performer.” Keep the lyric draft and any vocal consent records. Client And Portfolio Delivery
Give the client the license evidence, tool and plan name, creation date, human edits, and any AI disclosure wording required by the destination. If the brief involves film, television, studio games, or a recognizable performer, obtain written confirmation from the vendor and the relevant rights holders because some stated plans exclude those uses.

When The Evidence Is Not Enough
Pause publication if the plan does not state commercial permission, if the output contains a recognizable performer or melody, if a reference recording lacks consent, or if the platform requires a disclosure you cannot provide. “Royalty-free,” “AI-generated,” or a paid subscription alone does not establish every right needed for your particular release; verify the vendor’s current terms and keep the record with the project.
