Build a fire pit only after you have confirmed local rules, selected a design with complete manufacturer instructions, and planned conservative separation from buildings and vegetation. The U.S. Fire Administration (USFA) advises placing outdoor fire pits at least 10 feet from a home or anything that can burn; a separate USFA pictograph shows a 10-to-30-foot range from a home. Those figures are safety guidance, not a universal permit, setback, or code requirement. Your fire marshal, building department, air-quality agency, and the product instructions may require more distance or prohibit the fire entirely.

There is no universally lawful DIY pit diameter, wall thickness, foundation depth, material list, or placement distance. Construction requirements depend on whether the pit burns wood or gas, the exact product or custom design, the site, and local code. Use the steps below to make sound decisions without treating a generic plan as approval to build.

Start with permission, site conditions, and the design

Check rules before buying materials

Backyard burning can be restricted by municipal fire codes, building codes, air-quality rules, homeowner-association covenants, seasonal restrictions, and temporary burn bans. Ask the local fire department or fire marshal whether an outdoor fire pit is allowed at your address, whether a permit or inspection is required, and whether the proposed fuel and construction type are covered by different rules. Check again on every planned burn day because restrictions can change with weather, smoke conditions, or wildfire risk.

The U.S. Environmental Protection Agency (EPA) says local requirements vary and that backyard or open burning is often restricted on no-burn days. Its wood-burning FAQ addresses the question, “Can I use my wood stove, fireplace or firepit during a no-burn day or burn ban?” The practical answer is that the local order controls; do not rely on a general federal guideline to override it.

Choose a design with instructions you can follow

Decide whether you are installing a listed, packaged fire-pit product or constructing a permanent masonry feature. A packaged product should include fuel, assembly, clearance, ventilation, ignition, and shutdown instructions. A custom masonry pit needs a design appropriate to the site and fuel, with the foundation, drainage, wall assembly, and noncombustible materials specified by a qualified designer or installer and accepted by local authorities where required.

Do not copy dimensions from an indoor wood stove, fireplace, or another outdoor model. The EPA’s installation guidance concerns wood-burning appliances and venting, not a universal outdoor fire-pit plan. It identifies combustible clearances, floor protection, and proper assembly as installation considerations and warns that errors may not be immediately visible. The agency states: “The way your wood-burning system (appliance, chimney, and vent) is installed and taken care of can make a big difference in terms of safety and air emissions.” Read the full EPA Wood-Burning Installation and Maintenance guidance for that general principle, then follow the instructions for your actual product.

Map combustibles, people, and access

Walk the proposed location in daylight and mark the home, garage, sheds, fences, decks, play structures, vehicles, trees, shrubs, dry grass, overhead branches, utility equipment, propane storage, and wood piles. Include the area where sparks could travel and where people will sit or walk. Select a stable location that does not collect water, direct smoke toward doors or neighboring homes, or block emergency access. A fire pit should be visible from the house so an adult can supervise it continuously.

Use clearance guidance conservatively

Understand the two USFA distances

USFA’s Outdoor Fire Safety guidance says to use outdoor fire pits at least 10 feet from a home or anything that can burn. A separate USFA pictograph presents fire pits, wood piles, and propane tanks 10 to 30 feet from a home. The statements are not a single nationwide setback rule: one is a minimum safety recommendation and the other illustrates a range. Use the larger separation that your site, product manual, fire official, or code requires, and treat 10 feet as a floor rather than a target when combustibles or wind make a greater distance prudent.

Account for the whole installation

Measure from the fire and any exposed hot surfaces, not merely from the outside edge of a decorative surround. Include seating, screens, gas cylinders, wood storage, and items that can be moved next to the pit. A noncombustible pad or surround does not make an otherwise prohibited location lawful, and it does not protect a nearby wall, roof overhang, fence, or tree canopy from radiant heat or embers.

Construction dos

Do use a design-specific, noncombustible assembly

Use materials identified as suitable for the temperatures and fuel in your chosen design. Keep combustible framing, mulch, leaves, painted timber, and plastic components out of the hot zone. For a permanent build, have the installer explain how the base, drainage, wall, burner or grate, and any gas piping work together. Ask how the design accommodates inspection, cleaning, and replacement parts.

For a listed product, inventory every component before assembly. Confirm that the burner, grate, burner media, valves, ignition, guard, and screen match the model. Do not substitute a different burner, hose, regulator, stone, or glass media unless the manufacturer explicitly permits it. A component that fits physically can still change flame behavior, heat output, ventilation, or pressure.

Do provide required ventilation and access

Gas products commonly require openings or clearances specified by their manufacturer so leaked fuel does not accumulate. Keep those openings clear of soil, decorative rock, furniture, and snow. Place shutoff controls where an adult can reach them quickly without leaning across the flame. Route fuel lines and cylinders exactly as instructed, protect them from damage, and arrange professional installation when local rules or the manufacturer require it.

Do plan for inspection and maintenance

Keep the manual, model number, and purchase information. Photograph concealed connections before closing a surround so future repairs do not require guesswork. Before each season, inspect the structure for cracks, loose stones, corrosion, blocked vents, damaged hoses, and unstable grates. A permanent installation should be checked after severe weather, landscaping work, or any impact.

Wood-burning and gas designs: compare the decisions, not a blanket “safer” label

Decision point Wood-burning pit Gas pit
Fuel handling Needs dry, acceptable firewood and a safe storage location; burning creates embers and ash. Uses the fuel and cylinder or piping specified for the model; leaks, valves, regulators, and connections require model-specific checks.
Ignition Use dry kindling and natural or organic fire starters. Never use gasoline, kerosene, or charcoal starter. Use only the supplied or approved ignition system and follow the lighting and shutdown sequence.
Sparks and embers Requires active ember control and a compatible metal spark screen when the instructions allow or require one. May avoid wood embers, but flame, hot surfaces, and any decorative media still require clearance and supervision.
Restrictions May be covered by open-burning, smoke, air-quality, or no-burn-day rules. May be subject to fuel-storage, installation, or fire-code requirements even when wood burning is restricted.
Clearances Follow the pit’s instructions plus local requirements; sparks and radiant heat affect placement. Follow the product’s specified clearances, ventilation, cylinder location, and overhead restrictions.

Neither category is automatically safer or legal everywhere. Match every model-specific statement to the manufacturer’s documentation and your jurisdiction’s rules.

Fuel and ignition: what to burn and what to reject

Use clean, dry fuel

EPA recommends not burning wet or green wood. Damp fuel smolders, produces more smoke, and can make control difficult. Burn only dry, untreated firewood appropriate to the appliance and local rules. Do not burn household trash, plastic, painted or pressure-treated wood, or wood containing glue. Those materials can release harmful pollutants and may damage the pit.

Choose safe starters

Use dry kindling and natural or organic fire starters. Never pour or spray gasoline, kerosene, or charcoal starter onto a fire, whether it is newly lit or still smoldering. Keep starter products away from heat and follow their labels. If a fire does not catch, let the fuel cool and reassess rather than adding a volatile liquid.

Handle liquid-fuel tabletop products with special caution

On July 16, 2026, the U.S. Consumer Product Safety Commission warned consumers to stop using the named Houswise tabletop fire pits that require liquid fuel to be poured and ignited in the same location. The warning cites flame jetting and uncontrolled pool fires and covers at least 53,500 units. That number is the quantity in this specific warning, not an injury count or an estimate for all fire pits. Read the full CPSC notice. Do not generalize it to every fire pit, but do take any recall or warning for your exact model seriously and stop using a product when its regulator directs you to do so.

Operate the pit as an attended fire

Control sparks

For a wood-burning fire, use a properly sized metal screen to reduce escaping sparks. Check the screen for cracks, warped edges, and a handle that remains cool enough to use as designed. A screen is an ember-control device, not permission to leave the fire unattended; sparks can escape around gaps or when the screen is removed.

Supervise continuously

USFA advises close supervision of children around outdoor fires. Establish a clear boundary, keep loose clothing and flammable items away, and prevent children from handling fuel, screens, valves, or ignition controls. An adult who can act immediately should remain with the fire for its entire burn.

Extinguish before leaving

Put out a wood fire completely before leaving the backyard, going indoors, or going to sleep. Follow the pit’s extinguishing instructions; do not improvise a procedure that could damage a hot burner or spread embers. Turn off a gas fire at the control and fuel shutoff specified by the manufacturer, then verify that the flame is out and surfaces have cooled before covering or storing anything.

Weather, smoke, and neighbors

Do not light a fire during a burn ban, no-burn day, high-wind event, or other condition identified by local authorities. Wind can carry embers beyond the planned clearance and drive smoke into occupied buildings. If smoke is blowing toward neighbors, roads, or a window, postpone the burn. Keep doors and windows closed when smoke could enter, and stop the fire if conditions change.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Smoke-sensitive neighbors, children, older adults, and people with respiratory conditions may be affected even when a fire is lawful. A legal installation still requires considerate timing, clean fuel, and prompt extinguishing.

Common build and use mistakes—and the safer correction

  • Choosing a spot by appearance alone: Re-map every combustible and overhead branch, then apply the greater of local, manufacturer, and conservative USFA guidance.
  • Assuming a ring of stones is a complete pit: Use a design that specifies the base, heat-rated materials, ventilation, and fuel system; obtain approval where required.
  • Copying dimensions from another project: Treat dimensions as model- and jurisdiction-specific. Do not transfer indoor appliance clearances to an outdoor pit.
  • Mixing components: Reinstall only approved burners, hoses, regulators, media, grates, and screens.
  • Burning convenient waste: Reject trash, plastic, painted or treated wood, and glued wood; use appropriate dry fuel.
  • Lighting with liquid accelerants: Use dry kindling and approved natural or organic starters instead of gasoline, kerosene, or charcoal starter.
  • Leaving a “small” fire alone: Stay with it, keep children supervised, use a compatible metal screen for wood, and extinguish before departure.
  • Ignoring changing restrictions: Check local agencies before construction and again before each burn.

A pre-build and pre-burn checklist

  1. Ask the local fire and building authorities whether the proposed pit, fuel, location, and construction require a permit, inspection, or special setback.
  2. Check current burn-ban and no-burn-day notices from the relevant local and state agencies.
  3. Choose a product or custom design with complete instructions and a clear source for installation support.
  4. Map the home, other structures, vegetation, overhead branches, fuel storage, seating, and neighboring exposures.
  5. Apply the USFA guidance of at least 10 feet from a home or anything that can burn, compare it with the 10-to-30-foot pictograph range, and follow any stricter requirement.
  6. Confirm every construction material, burner component, grate, ignition, ventilation opening, and screen is approved for that design.
  7. Before lighting, inspect for damage, confirm the weather and legal status, stage the approved fuel and starter, and establish supervision.
  8. During the fire, control sparks, keep children closely supervised, and watch for wind or smoke changes.
  9. Before leaving, complete the manufacturer’s shutdown or extinguishing procedure and verify that no flame, glowing ember, or unsafe heat remains.

Keep guidance current

USFA’s outdoor-fire page was last reviewed August 8, 2024, and its distance pictograph was last reviewed November 2, 2021. EPA says its Burn Wise materials stopped updating October 30, 2025. The CPSC warning cited above is dated July 16, 2026. Local rules, weather restrictions, recalls, and product manuals can change after those dates, so verify the current version before building or burning.
