On July 14, 2025, cartoonist Hemant Malviya agreed through his lawyer to remove a social-media post after the Supreme Court criticized it during a hearing on his anticipatory-bail plea. The hearing was a procedural step, not a trial or a finding that the allegations against him were true.
What happened at the July 14 hearing
A Supreme Court bench of Justices Sudhanshu Dhulia and Aravind Kumar was hearing Malviya’s challenge to the Madhya Pradesh High Court’s refusal to grant him anticipatory bail. After the judges criticized the post, his counsel agreed to take it down and said Malviya would issue a statement clarifying that amending his work did not mean he endorsed the comments added to it.
The Indian Express reported Justice Dhulia asking whether Malviya would remove the post and saying, “Still no maturity. We agree that it is inflammatory.” Scroll described the bench’s criticism as referring to the material as “immature and inflammatory.” These were remarks during a hearing, not a final ruling on the allegations or on the legality of political cartoons.
Malviya’s counsel said the cartoon was his client’s work but the added words were not. Counsel also acknowledged that the cartoon and comments could be considered unpalatable or in poor taste.

What the cartoon showed—and what was added later
Scroll reported that Malviya published the original cartoon on January 6, 2021. It depicted Narendra Modi as a doctor administering an injection to a man dressed in clothing that could be read as an RSS uniform. Its Hindi caption referred to a claim that some Covid-19 vaccines were no more effective than water.
According to The Indian Express, a Facebook user reused the cartoon in May 2025 with additional comments in the context of the government’s decision on a caste census. Malviya reshared the altered post. His counsel said the added words were not his. An RSS member’s complaint led to a police case; the accusations reported in connection with that case remain allegations, not established findings of guilt.

How the case developed after the hearing
- July 3, 2025: The Madhya Pradesh High Court refused Malviya anticipatory bail.
- July 14: The Supreme Court heard his challenge. His counsel agreed to remove the post following the bench’s criticism.
- July 15: The Supreme Court granted interim protection from arrest while allowing the case to proceed. The state opposed deleting material while it remained under investigation.
- August 19: The Court allowed Malviya ten days to publish an apology across his social-media accounts, including Facebook and Instagram. The state objected to deletion because it considered the post part of the investigation. The Court listed the matter again to monitor the apology and consider further orders.
Hindustan Times reported the bench referring to an affidavit dated August 16 in which Malviya tendered a “whole hearted apology,” adding that it hoped and trusted the apology was “not from the pen but from the heart.” That wording is reported as the bench’s statement, not presented here as a checked transcript.

The case arose from a complaint alleging that social-media material harmed religious sentiments and targeted the RSS. The Indian Express listed Bharatiya Nyaya Sanhita sections 196, 299, 302, 352 and 353(2), along with section 67A of the Information Technology Act; reports do not list the provisions uniformly. The precise charges should therefore be checked against the FIR or court record if they matter.

The reported hearings document judicial criticism, bail proceedings, interim protection and an opportunity to publish an apology. They do not establish that Malviya was convicted, that a court found the allegations proved, or a final legal rule about political cartoons and free speech. The reports available through the August 19 update do not establish the case’s final disposition.
