Do not treat a proposed building-product substitute as an automatic equivalent. Treat it as a documented change that must be checked against the specified product, the project’s measurable performance requirements, the complete building system, the owner’s needs, and the approvals required in the project’s jurisdiction. Obtain written acceptance before ordering or installing it, and preserve the evidence and decision in the contract record.

The governing law, consent route, contract language, and allocation of responsibility vary by jurisdiction and project delivery method. The sequence below is a disciplined review framework, not a universal legal opinion.
Why a substitution is a compliance decision, not a purchasing decision
A product named in drawings or specifications is usually part of a larger design solution. Its fire, structural, moisture, acoustic, thermal, durability, accessibility, environmental, or finish characteristics may have been relied on when the design was coordinated and submitted for approval. Replacing it can reopen questions that appeared to be settled during design.
#1 Best Overall
The Australian Institute of Architects’ practice note Substitutions, published on 8 April 2020 and edited on 22 May 2024, cautions that reviewing and accepting substitutes creates significant risk for architects. That risk is not limited to whether a replacement looks similar or carries a familiar trade description. A change can affect connected products, installation details, warranties, maintenance, certification, cost, and the building’s intended use.
Price, an unavailable specified product, a programme problem, or an owner request may justify considering an alternative. None of those reasons proves equivalence. The person proposing the change should show, with project-specific evidence, how the candidate satisfies the same requirements or identify every departure for a conscious decision.
Start by fixing the governing framework
Collect the documents that control the decision
Before comparing products, assemble the specification section, drawings, schedules, addenda, basis-of-design information, schedules of finishes or equipment, consent documents, and the executed contract’s substitution clauses. Check whether a later bulletin or clarification changed the original requirement. Record the exact product name, manufacturer, model, performance designation, accessories, and installation system shown in those documents.

A product accepted under one country’s approval route may need a different demonstration elsewhere. Do not assume that a substitution clause overrides a building approval, planning condition, fire strategy, heritage requirement, or lender or insurer condition.
Read the contract’s timing and authority rules
Look for deadlines, notice forms, review periods, cost and programme provisions, and the person authorised to accept a change. Some contracts allow an architect or contract administrator to review technical compliance but reserve a material change to the owner, design professional, building official, or another named party. An informal email or site conversation is not a substitute for the procedure in the executed contract.
The AIA-MBA Joint Committee’s Bidding guidance, Section C-6, discourages undefined terms such as “or equal” and “or approved equal.” Its recommendation, with a history approved in June 2010, is to state clearly what the architect would consider an equal product. A useful specification identifies the basis of design, required characteristics, acceptable evidence, submission timing, and the decision-maker.
Require a complete substitution package
Do not begin a technical review from a product brochure alone. Require one coordinated submission that allows the reviewer to compare the proposed item with the specified item under the same conditions.

State the reason and scope
The request should name the reason—such as availability, schedule, price, owner preference, or a documented design development—and identify every location and quantity affected. It should say whether the change is limited to one product or also changes primers, fasteners, membranes, sealants, control systems, substrates, accessories, or installation methods.
Identify both products precisely
Use manufacturer, product family, exact model or grade, size, finish, colour, formulation, manufacturing location where relevant, and current technical data for the specified and proposed products. “Equivalent waterproofing,” “similar coating,” or “comparable panel” is not a product identification. State the edition and date of each data sheet or certificate so obsolete information is not mistaken for current evidence.
Supply evidence of suitability
The Australian Building Codes Board (ABCB) says designers must understand and specify performance requirements and that procurers should obtain evidence demonstrating suitability. Depending on the requirement, that evidence can include test reports, conformity or certification documents, declared performance, engineering calculations, installation instructions, safety information, durability data, environmental declarations, and evidence that the proposed product is approved for the intended use. Ask who performed a test, to which standard, on what assembly, and whether the tested configuration matches the project.

List differences explicitly
Require a side-by-side deviation schedule. It should identify any change in dimensions, tolerances, weight, reaction to fire, fire resistance, acoustic or thermal values, water or air performance, chemical resistance, emissions, colour, gloss, texture, maintenance interval, warranty, lead time, packaging, or installation sequence. A blank statement that there are “no differences” is not a substitute for checking each applicable criterion.

Describe installation and quality controls
Include substrate preparation, compatible primers or adhesives, temperature and humidity limits, curing or sequencing requirements, tools, jointing, protection, inspection points, commissioning, and remedial procedures. A product can meet a laboratory value yet fail when installed on the project’s substrate or alongside the specified adjoining materials. Identify the installer qualifications, manufacturer attendance, mock-ups, samples, hold points, and inspection records required for the proposed system.
Compare every candidate against the same requirements
Use one matrix for the specified product and each candidate. The following axes reflect considerations identified by professional and government guidance; they are not universal weightings. The project team must decide which are pass/fail and which can be balanced.
| Review axis | Questions to answer | Evidence or action |
|---|---|---|
| Code and standards | Does the product meet the applicable code clauses, referenced standards, and authority conditions in the proposed assembly? | Current certificates, test reports, calculations, declarations, and an assembly-specific compliance statement. |
| Performance and fitness for use | Does it deliver the specified structural, fire, moisture, acoustic, thermal, durability, safety, and finish performance for the actual exposure and occupancy? | Compare measured values, test conditions, design assumptions, service life, limitations, and intended-use instructions. |
| System compatibility | Will it work with adjoining products, substrates, fixings, coatings, membranes, controls, and movement joints? | Compatibility letters, coordinated details, revised calculations, mock-ups, and manufacturer instructions. |
| Design and consent effect | Do dimensions, loads, appearance, fire strategy, access, or details change? Is an amendment or new approval needed? | Marked-up drawings, revised schedules, design-team review, and authority confirmation where required. |
| Installation conditions | Can the project team install it within site temperature, moisture, sequencing, access, and inspection constraints? | Method statement, programme, training, hold points, samples, and quality records. |
| Owner requirements | Does it satisfy the owner’s operational, aesthetic, maintenance, warranty, sustainability, and cleaning expectations? | Owner sign-off on samples, maintenance information, guarantees, and lifecycle implications. |
| Commercial and programme effects | What changes in purchase price, labour, lead time, waste, preliminaries, maintenance, or delay exposure? | Transparent cost and schedule comparison; do not treat a lower purchase price as proof of value. |
When several candidates are submitted, apply the same matrix to all of them. The available guidance identifies these considerations but does not prescribe a universal scoring formula. A project may reasonably make fire compliance a gateway requirement, for example, while treating colour or lead time as a later choice; the decision and its rationale should be recorded.
Check effects beyond the individual product
Review the complete assembly
Trace the product through every connected detail. A different board thickness can alter a jamb, flashing, cavity, fastener length, or insulation continuity. A different coating can affect a substrate primer, vapour control layer, fire rating, or cleaning regime. A replacement fitting can change electrical loads, controls, access clearances, commissioning, and maintenance. Ask the relevant designers and specialist subcontractors to review revised details rather than accepting a catalogue statement in isolation.

Confirm that the substitute still supports the reason the original was selected: appearance, tactile quality, acoustic separation, weathering, accessibility, safety, energy performance, durability, or a particular operational requirement. Obtain new samples or mock-ups where visual or tactile differences matter. If the owner’s brief or a planning condition names a material, finish, colour, or environmental attribute, obtain the owner’s and authority’s required consent before commitment.
Determine whether an approval changes
New Zealand Building CodeHub guidance addresses substitutions for products appearing in building consent applications. It advises showing the council how the proposed product meets Building Code requirements and considering the legal context, building implications, intended purpose, owner needs, and possible consent amendments. That is a New Zealand pathway, not a rule for every country. In another jurisdiction, the applicable building official, fire authority, planning authority, certifier, or contract administrator may have a different process. Verify the live requirement before procurement.
Use a controlled approval sequence
- Log the request. Assign a reference, date, proposer, affected locations, reason, and required response date. Confirm that procurement has not committed the project to the candidate.
- Check completeness. Return submissions that lack exact product identification, current evidence, installation information, or a deviation schedule. A review clock should start only when the agreed package is complete.
- Run the technical comparison. Have the responsible design disciplines assess the matrix, connected assemblies, calculations, samples, and installation method. Record assumptions and unresolved questions.
- Obtain owner and authority input. Seek the owner’s decision where appearance, operation, maintenance, cost, or warranty changes. Submit any required amendment, notification, or alternative-solution documentation to the relevant authority.
- Apply the contract criteria. The authorised reviewer should decide within the stated review period and against the criteria in the contract documents. A technical comment is not acceptance unless the contract gives that person acceptance authority.
- Issue written acceptance or rejection. If accepted, define the exact product, locations, conditions, revised details, cost and programme treatment, and any required inspections. For a bid-stage substitution, record the accepted change in a formal addendum; the AIA-MBA Joint Committee recommends this approach.
- Release procurement only after approval. Tell purchasing, site management, subcontractors, and inspectors which revision governs. Prevent an unapproved earlier or later model from being delivered.
- Verify installation and close out. Check delivery labels, batch or model information, substrate conditions, installation records, tests, commissioning, warranties, and as-built documents. Resolve deviations before concealment.
Who does what—and what review does not transfer
Responsibility is distributed among the parties and depends on the law and contract. A reviewer’s acceptance does not automatically transfer the proposer’s duty to provide accurate information, the designer’s duty to design, the builder’s duty to install correctly, or the authority’s statutory function.
| Party | Typical responsibility to confirm |
|---|---|
| Specifier or design professional | Define performance requirements, assess design and system effects within the agreed scope, identify required changes, and document the design decision. |
| Contractor or supplier proposing the substitute | State the reason, provide complete and truthful product evidence, identify deviations, coordinate installation information, and avoid ordering or installing before approval. |
| Procurement team | Obtain suitability evidence, purchase the approved model and accessories, preserve certificates, and prevent unauthorised substitutions in the supply chain. |
| Builder and installer | Use the approved product, follow instructions and workmanship requirements, report site conditions that differ from assumptions, and retain inspection and installation records. |
| Owner | Confirm owner-specific functional, aesthetic, maintenance, cost, and warranty consequences where the contract requires owner decisions. |
| Approval authority or certifier | Perform the statutory review assigned by local law; an approval does not replace the project team’s technical coordination or contractual duties. |
The UK Government’s Construction Products Reform White Paper describes proposed duties for parties specifying or substituting products and for installers concerning safe use and workmanship. Those are proposals in a reform framework, not a statement of universally applicable or already operative law. Check the current legislation and project contract in the relevant jurisdiction.
Keep a decision trail that survives handover
ABCB guidance recommends retaining relevant compliance certificates with the contract documentation and providing them to the building owner at completion. The substitution record should include the request, reason, original and proposed product data, test and conformity evidence, deviation matrix, calculations, marked-up drawings, samples or mock-up approvals, meeting decisions, authority correspondence, contract instruction or addendum, procurement records, delivery checks, installation inspections, tests, warranties, and the final product installed.
Best Value
Use a controlled revision system so the construction team can distinguish an accepted substitution from a rejected proposal or superseded model. A document-management or field-recording tool can help organize evidence, but software is only a recordkeeping aid; it is not proof that a product complies.
Failure modes and practical fixes
“It is the same product, just another brand”
Why it fails: trade descriptions hide differences in formulation, dimensions, certification scope, or installation. Fix: demand exact model data and compare each project requirement.
The request arrives after delivery
Why it fails: schedule pressure turns a review into a fait accompli and may create storage, return, or rework costs. Fix: make submission and no-order-before-approval requirements explicit, then log non-compliant deliveries and quarantine them pending a decision.
Quick wins for a faster PC:
Scan for outdated or missing drivers - takes under a minuteDriver Scan →Repair Windows errors before they cause bigger problemsFix Now →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →A certificate is attached but does not match the assembly
Why it fails: a test may cover different thicknesses, substrates, joints, exposure, or installation conditions. Fix: check the certificate’s scope and limitations against the project detail; obtain an engineering assessment or revised test evidence when needed.
Approval is verbal
Why it fails: parties later disagree about what was accepted, where it applies, or who bore the cost and risk. Fix: issue a dated written decision with the product, locations, conditions, authority, and resulting document revisions.
Only upfront price is compared
Why it fails: labour, lead time, waste, maintenance, warranty, re-testing, and redesign can outweigh a purchase saving. Fix: compare whole-project cost and programme effects while preserving the required performance.
Field checklist before release
- Applicable jurisdiction, code edition, authority, and consent documents identified.
- Specification, drawings, basis of design, addenda, and substitution clause reviewed.
- Reason, affected locations, quantities, and requested decision date recorded.
- Specified and proposed products identified by exact model, grade, size, and finish.
- Current suitability evidence, test scope, conformity information, and limitations supplied.
- Differences in performance, dimensions, appearance, installation, maintenance, warranty, cost, and programme listed.
- Connected assemblies, calculations, details, samples, and specialist interfaces reviewed.
- Owner, design disciplines, certifier, building official, or other authority consulted where required.
- Written acceptance, rejection, or conditional acceptance issued by the authorised party.
- Approved revision distributed before order or installation; delivery and installation records retained for handover.
A compliant substitution is therefore an evidence-based, authorised change—not a shortcut around the specification. If the team cannot demonstrate suitability, compatibility, approval status, and a clear record of the decision, the proposed product is not ready to be ordered or installed.
