The selection that prompted the dispute was a photograph of Glacier National Park by Akshay Joshi. Courthouse News Service reported that the National Parks Foundation selected it in June 2025 from 7,000 contestants. The image was assigned to the nonresident annual pass, rather than the resident pass. Interior’s announcement does not explain why the contest-winning photograph was assigned to the nonresident pass. Why are critics challenging the design?
The Center for Biological Diversity filed a complaint on December 10, 2025. It argues that the Federal Lands Recreation Enhancement Act requires an annual public competition for the image used on the annual pass, and that the contest-winning image should have appeared on the resident pass. Senator Jack Reed made a similar argument in a January 16, 2026 statement, quoting the statute’s annual-competition language. He said, “America the Beautiful access cards are not political and should not be sullied with President Trump’s image. What is the lawsuit’s latest accessible status?
The latest accessible record for Center for Biological Diversity v. Burgum, No. 1:25-cv-04285, was retrieved May 22, 2026. It lists a government motion to dismiss filed that day. The docket also says a May 6 order stayed the government’s response to the plaintiffs’ summary-judgment motion while the government pursued its dismissal motion. Can you cover the portrait with a sticker?
Some passholders responded to the resident design by placing stickers over Trump’s portrait, including images of wildlife, landscapes, and smiley faces. NPR reported on January 10, 2026, that the National Park Service had clarified guidance to include stickers or markings as possible alterations. Interior told NPR it viewed this as a clarification of the existing “void if altered” condition, not a new rule; whether a particular pass counts as defaced was left to official discretion. Do not assume a sticker—or a sleeve that covers the artwork—is allowed. The cited sources do not establish that a sleeve complies with pass conditions, and altering the pass could put its validity at risk. A Reddit thread titled “Has anyone covered up the America the Beautiful pass and actually been denied entry?” reflects a practical concern, but its title is not proof of an enforcement outcome.
