Generative AI Has a Visual Plagiarism Problem. Here’s What That Means for Artists and Users

Some AI image generators can produce recognizable or near-reproductions of protected imagery. Here’s how to distinguish memorization, imitation, training disputes, and practical commercial risk.

Image generators can sometimes produce pictures that closely resemble—or nearly reproduce—recognizable films, games, characters, and other copyrighted works. That is a real visual-plagiarism problem, but it does not mean every AI image is copied, that every resemblance is infringement, or that courts have settled whether training on copyrighted images is lawful.

For artists and anyone using generated images, the key is to separate three questions: what went into training, whether a particular output reproduces protected material, and what a user chooses to request or publish. They overlap, but none answers the others by itself.

What “visual plagiarism” means—and what it doesn’t

“Visual plagiarism” is a useful description of an ethical and practical problem, not a precise legal verdict. An image can look derivative without infringing copyright; an image can also raise legal concerns even when its creator did not knowingly copy a source.

It helps to distinguish five things:

  • Influence or style: Broad visual conventions such as watercolor, film noir, or anime. A general style is not the same as a particular protected image.
  • Recognizable imitation: An output evokes a specific character, franchise, or artist, whether or not it duplicates one image.
  • Substantial similarity: A legal question that can depend on protectable expression and the facts of a particular work, not just a viewer’s sense that two images feel alike.
  • Near-reproduction: An output preserves an unusually distinctive composition, pose, camera angle, lighting, props, and background from a source.
  • Memorization: In technical research, a model’s ability to reconstruct a near-exact copy of a substantial portion of a training example. This is narrower than merely learning from, or being influenced by, an image. Research on memorization and image-generation models documents that such reconstruction is possible under some conditions.

Resemblance alone does not prove copying. It may reflect common genre conventions, familiar archetypes, deliberate prompting, related images in training, or independent generation. A stronger warning sign is a cluster of distinctive details that align with a particular source, especially when similar results recur across prompts or seeds. Even then, establishing what happened technically and whether it is legally actionable are separate tasks.

What the Midjourney investigation showed

In a January 2024 IEEE Spectrum investigation, researchers described experiments with Midjourney V6 and DALL·E 3 that produced recognizable imagery resembling films, television, games, and cartoons. They reported close matches and character-like replicas, sometimes after indirect prompts rather than explicit titles or character names. One example they discussed was the generic term “screencap,” which could evoke imagery resembling a frame from a known film or show.

The authors reported hundreds of recognizable examples during their investigation. That is evidence that these systems could generate such outputs in the tested circumstances; it is not a controlled estimate of how often all users will get infringing images. Nor did the investigation establish the training provenance of every output or prove that every source image was in a particular model’s dataset. The experiments are an important case study, not a court ruling.

The practical lesson is that a system may produce a recognizable result without a user typing the exact protected title. Generic production language, a combination of visual cues, or an uploaded reference can all matter. Conversely, a prompt that names a character does not by itself prove that the resulting image copies a particular protected work.

How a model can reproduce an image without being a photo database

Image generators are not necessarily retrieval systems that look up and paste a stored file whenever someone enters a prompt. During training, models adjust a large set of parameters based on examples. They can learn general relationships—such as what a camera angle, costume, or lighting pattern tends to look like—without retaining a usable copy of every training image.

But compression is not a guarantee against reproduction. Some examples may be retained unusually strongly, especially if an image or caption appears repeatedly, contains rare or distinctive features, or can be elicited by a specific prompt. Model architecture, training procedures, later fine-tuning, and refusal systems can also affect what is reproduced. A model’s output is stochastic, so the same prompt need not produce the same result every time.

These distinctions matter because “the model learned a style” does not explain every close match, while “the model stores every image” overstates what the evidence supports. Without a reliable record connecting a particular output to particular training examples, it can be difficult to establish why a specific resemblance occurred.

Three different copying questions

1. Was the training material used lawfully?

Generative systems are trained on large image collections, and the status of copying works for training remains a major legal dispute in the United States. Relevant facts may include whether images were licensed, public domain, supplied under appropriate terms, or gathered without permission; how the training use affects markets for the works; whether a model retains or reproduces particular works; and what licensing, opt-out, or compensation measures a developer offers.

The U.S. Copyright Office treats the training question separately from whether a person can copyright an AI-generated output. Its AI initiative includes work on training, licensing, and potential liability, while its Part 2 report addresses output copyrightability. The Copyright Office and Congress’s Congressional Research Service overview describe a fact-specific issue: some training uses may qualify as fair use and others may not. There is no blanket U.S. ruling that all such training is lawful or unlawful.

2. Does a particular output copy a protected work?

An output could raise a reproduction or derivative-work issue even if nobody can prove exactly which training image influenced it. The analysis is about the particular output and source, not simply the model’s general training method. Copyright is not the only concern: a recognizable character or logo may also raise trademark issues, while use of a person’s likeness can involve publicity or privacy rights, depending on the facts and jurisdiction.

3. Did the user direct the copying?

A user can deliberately ask for a protected character, upload a copyrighted reference without permission, or request an imitation that creates a false association with an artist or brand. A tool’s existence does not make every use unlawful; a tool may be used lawfully while a particular request or publication is not. Nor does a user’s lack of intent settle whether an output can infringe.

Why entertainment characters are a flashpoint

Famous franchises have abundant online imagery, repeated character names, distinctive and consistent designs, and audiences who can identify them quickly. Their commercial value also makes unauthorized commercial use particularly contentious. A generated image may implicate both copyright in character expression and trademark concerns if it suggests an official product or endorsement.

The dispute has moved into major litigation. Disney and NBCUniversal sued Midjourney in 2025, alleging that the service trained on copyrighted material and generated unauthorized images of protected characters. Warner Bros. later filed a separate lawsuit involving characters including Superman and Bugs Bunny. Associated Press reporting on the Disney and NBCUniversal case and its report on Warner Bros.’ case describe the claims. The complaints are allegations, not findings that the companies have proved infringement or that Midjourney is liable. The cases illustrate that rights holders may pursue platforms as well as users; they do not resolve the broader training question for every model.

Style imitation is not the same as copying a work

Asking for “baroque,” “watercolor,” or “film noir” generally describes broad visual qualities, not a particular protected image. Asking for work “in the style of” a living artist raises distinct ethical and commercial concerns: it may substitute for that artist’s market, imply an association, or produce details traceable to specific works. Whether a particular use violates a law depends on the jurisdiction and facts; style imitation is not automatically illegal.

Platforms may impose stricter rules than copyright law. Adobe, for example, says it has adjusted moderation policies to make it easier to report prompts or outputs that reference or replicate artists’ names and styles without permission. That is a platform policy and risk-control measure, not a universal legal ruling. Adobe’s description of Firefly’s approach should be read as the company’s account of its safeguards, not as a guarantee that all outputs are clear of rights claims.

Why filters and provenance tools cannot settle the issue

Prompt filters can block obvious requests for famous characters, logos, film titles, or living artists. That may prevent some outputs, but it does not solve the underlying problem:

  • Users can describe a character indirectly or combine cues without naming the property.
  • A blocklist may miss new works, alternate spellings, translations, or image-reference workflows.
  • Filters can suppress legitimate uses as well as problematic ones.
  • A refusal does not reveal what images were used in training, compensate creators, or prove that unblocked outputs are original.
  • Open or local models and post-processing can make platform controls easier to bypass.

Nor are all “provenance” tools equivalent. Content credentials can record information about how an image was created or edited. Watermarks may signal that an image was AI-generated. Similarity search may locate visually related images. Training-data provenance would document sources used to build a model. Output attribution would connect an image to a particular source. A watermark or credential does not by itself identify the training images behind an output, and reverse-image search cannot reconstruct the full causal history of a generation.

Commercial safety is about process and contract, not a magic label

Businesses should judge an image service on more than visual quality. Look for a public description of training sources, licensing or public-domain commitments, opt-out or compensation programs, and disclosure of third-party models. Then examine safeguards across the actual product you plan to use: web interface, API, and enterprise edition may differ.

Adobe positions Firefly as a commercially oriented option and says it uses safeguards intended to reduce IP-infringement risk. It also advertises IP indemnification for enterprise customers. Those statements are relevant, but they are not a court-certified guarantee. The Adobe generative-AI product-specific terms marked effective April 23, 2026 and the applicable plan agreement control what protections apply. Check eligibility, exclusions, geography, covered claims, user-upload conditions, notice requirements, and defense control before relying on indemnity.

Commercial-use permission is not the same as a promise that every result is noninfringing. Midjourney’s commercial-use guidance describes use under its terms and says an image created by another user remains that creator’s when someone else upscales it. Read the current terms for the plan and jurisdiction in question; permission to use a service does not establish copyright ownership of every output or erase third-party rights.

For a high-value campaign, a licensed stock image or commissioned illustration may offer clearer provenance and stronger documentation, though it can cost more and take longer. A service with documented sourcing and enterprise indemnity may reduce some exposure, but it cannot make a risky prompt or use case automatically safe.

A practical review checklist for artists and businesses

  1. Match the tool to the job. Generic backgrounds and private concept exploration are different from packaging, a mascot, a book cover, or a national advertising campaign. Use commissioned or licensed artwork when exclusivity and clear provenance are central.
  2. Avoid unlicensed protected material. Do not request a famous character or logo, claim association with a living artist, or upload third-party artwork as a reference unless you have the rights needed for that use.
  3. Protect confidential inputs. Review the service’s data terms before uploading client work, unpublished designs, personal images, or confidential references. Private brainstorming reduces public-distribution exposure but does not eliminate confidentiality, privacy, or contract concerns.
  4. Inspect the result, not just the prompt. Look for recognizable characters, marks, costumes, set designs, and distinctive compositions. A changed color palette or expression is not a dependable “different enough” test.
  5. Search when the stakes justify it. For valuable public-facing assets, use reverse-image or similarity searches as a screening step. A match can be a warning; no match is not proof of originality or clearance.
  6. Keep records. Preserve prompts, model and version, seeds if available, reference-image permissions, edits, and the human work added. Records can help explain the process, though they do not prove non-infringement by themselves.
  7. Review contract protection. Confirm who qualifies for indemnity, what claims and uses are excluded, whether uploads or intentional misuse void coverage, and what notice and cooperation the vendor requires.
  8. Escalate consequential work. Get legal review for advertising, packaging, entertainment art, editorial covers, brand assets, and other high-exposure uses. Ask a human artist to create or substantially transform distinctive work where ownership and provenance matter.

Risk is generally lower for generic internal ideation than for direct generation of a franchise character, but “lower” is not “zero.” Likewise, a human-edited composition may be easier to review and document, yet editing does not automatically cure copying in the source or underlying output.

One more asymmetry: owning an image versus being allowed to use it

In the United States, a prompt alone generally does not make a user the copyright author of an otherwise AI-generated image. The Copyright Office says human-authored elements, creative selection and arrangement, or substantial human modification may be protectable, while purely generated portions may not be. Its Part 2 report and the Library of Congress summary explain the distinction.

This creates a mismatch: you may have limited ability to stop others copying the purely generated parts of an image you made, while still facing a claim if that image reproduces someone else’s protected expression. Output ownership, permission to publish, and a vendor’s promise to defend a claim are three different questions.

The accountability gap

The strongest case for calling this a visual-plagiarism problem is not that every generated image is stolen. It is that some systems can yield strikingly recognizable or near-reproduced imagery, while ordinary users often cannot see what data shaped a model, reliably identify a source, or tell what contractual protection they actually have. Better transparency, licensing, safeguards, and human review can reduce risk. None turns resemblance into a settled legal answer, and none makes the underlying dispute disappear.
