To get a toy made, take it through nine controlled stages: define the play experience and age grade, build and test a prototype, write a production specification, secure ownership, choose licensing or self-manufacturing, obtain comparable factory quotes, complete market-specific safety work, run a controlled pilot, and launch with compliant packaging and traceability. A prototype proves the idea; it does not by itself prove that a factory can make it safely or that you may sell it.
1. Define exactly what you are making
Start with a written product brief before approaching a factory, licensee or designer. Describe the play pattern (what a child does and why it is fun), intended age range, target buyer, dimensions, materials, colors, moving or electronic parts, and expected retail price. Identify foreseeable misuse as well as normal play: throwing, biting, pulling, climbing, water exposure, battery access and use by younger siblings can change the design and testing required.
Study competing toys, their price points, packaging claims and reviews. Look for an unmet need, but do not assume that a novel theme is protectable or commercially distinct. Your brief should also state the target sales geography because age grading, warnings and conformity obligations differ by market.
2. Build a prototype that demonstrates the play value
Make the simplest working model that lets representative users perform the core play action. Cardboard, 3D prints, sewn samples, off-the-shelf mechanisms or temporary electronics can be appropriate at this stage. The objective is to learn, not to make a showroom-perfect object.

Test with real users and observe failure
- Watch children in the intended age band use the prototype without coaching.
- Record confusion, boredom, pinching, sharp edges, breakage, swallowed or detachable parts, battery access and other misuse.
- Test packaging and instructions as well as the toy; a child may encounter the product before an adult reads the directions.
- Iterate until the play experience and basic safety assumptions are stable.
Ontario government prototype guidance calls for a clear description, a test version with packaging, feasibility costing, prototype testing and specification documents. Do not pay for production tooling until the core design has survived these learning cycles; tooling changes after launch can be expensive and can invalidate earlier safety work.
3. Turn the tested model into a production specification
A factory quote is meaningful only when every supplier is pricing the same product. Create a controlled specification package containing:

- part list, component sources, fasteners, adhesives, batteries and electronics;
- tolerances, assembly sequence, permissible substitutions and process limits;
- packaging dielines, inserts, instructions, warnings, labels and barcode requirements;
- cosmetic standards, functional checks, destructive tests and acceptance limits;
- sample approval procedure, revision number and change-control process.
Keep dated versions and make sure the design sent to production is the same version used for testing. Record who approved each change. A different plastic, paint, battery, magnet, seam or enclosure can alter both performance and compliance.
4. Protect ownership before you disclose the files
Use confidentiality agreements with independent designers, contractors, sourcing agents and factories where appropriate. Before sending CAD, artwork, code or tooling drawings, put ownership terms in writing. Specify who owns design files, molds, fixtures, test jigs, tooling deposits, improvements and production data, and whether the factory may disclose, reuse or manufacture the design for anyone else.

Match the protection to the asset
- Patents: potentially relevant to a novel functional invention; filing strategy depends on jurisdiction and timing.
- Trademarks: protect brand names, logos and other source identifiers.
- Copyright: may cover original artwork, characters, packaging copy, instructions and software, subject to local law.
- Contracts: assign deliverables and clarify confidentiality, tooling custody, payment milestones, warranties and remedies.
Patent, trademark and copyright rights are jurisdiction-specific. Have a qualified intellectual-property lawyer review filings and agreements before public disclosure or signing a manufacturing deal. Keep dated sketches, test records and revision histories as evidence of development and decision-making.
5. Choose licensing or self-manufacturing
There is no universally superior route. Compare the operational burden you can carry with the control and upside you want.

The Toy Association’s Toy Inventor and Designer Guide, Seventh Edition 2023 covers licensing and bringing a product to market. Use it as a framework for questions, not as a substitute for a negotiated contract or market-specific legal advice.
6. Source production with comparable quotes
Send the identical specification, target quantity, packaging plan and destination markets to each qualified factory or sourcing agent. Ask for a written breakdown rather than a single unit number. At minimum, request:

- tooling and engineering charges, sample charges and payment milestones;
- minimum order quantity, unit price at each volume and capacity in your target window;
- materials, component substitutions and supplier traceability;
- lead time for samples, tooling, production and corrective work;
- quality system, inspection plan, defect limits and rework policy;
- ability to support the required laboratory tests and documentation;
- packaging, freight terms, duties, insurance and destination delivery assumptions;
- confidentiality, tooling ownership, data access and end-of-life arrangements;
- environmental and labor practices relevant to your customers and channels.
Compare local, overseas and self-manufacturing on the same axes: control, upfront capital, minimum order, unit economics, lead time, quality, compliance capability, IP and tooling ownership, shipping and sustainability, and distribution reach. A low quoted unit price can be outweighed by tooling, testing, freight, defects, high minimums or unusable inventory.
Why a universal manufacturing cost is misleading
No defensible average cost applies to every toy. Materials, size, electronics, part count, tooling complexity, order quantity, packaging and destination market determine the estimate. Build a model from supplier quotations and laboratory estimates for your actual design instead of relying on an online “cost per toy” figure.

Do not treat a prototype, a factory’s general certificate or approval in one country as permission to sell everywhere. Requirements depend on age grading, construction, materials, coatings, chemicals, electronics and intended use. Engage the appropriate laboratory or conformity professional early, before freezing materials and tooling.
United States
The Consumer Product Safety Commission says the toy safety standard is ASTM F963, incorporated by 16 C.F.R. part 1250. CPSC identifies ASTM F963-23 as applying to applicable children’s toys manufactured on or after April 20, 2024. Its Toy Safety FAQ states: Third-party testing and certification are required for toys designed or intended primarily for children 12 and under.

The manufacturer or importer must identify the applicable sections, use a CPSC-accepted third-party laboratory where required, and issue the required certification. The test program must be based on the actual design: materials, construction, electronics, coatings and intended use determine which sections apply. Obtain a laboratory estimate against the controlled specification and retain reports and certification records.
European Union
For the EU, the manufacturer must assess chemical, physical, mechanical, electrical, flammability, hygiene and radioactivity hazards, including potential exposure. Follow the applicable conformity-assessment route, prepare technical documentation and an EU Declaration of Conformity, and affix the CE mark before placing the toy on the market. The European Commission states: Only toys bearing CE marking can be placed on the EU market.
Keep the technical file aligned with the production design and reassess it when materials or components change.

The UK has separate Toys (Safety) Regulations guidance for manufacturers, authorised representatives, importers and distributors. Verify the current obligations, marking, documentation and responsible-person requirements for the part of the UK in which you will sell; the guidance page was shown as updated March 24, 2025.
India
India’s government states that toys for children under 14 must conform to specified Indian Standards and bear the BIS/ISI mark, with factory assessment and laboratory testing. Confirm the current standard, registration and marking process before shipping.

Build a compliance file
- age-grade rationale and hazard assessment;
- bill of materials, supplier declarations and material test evidence;
- drawings, photographs, labels, warnings and instructions;
- laboratory reports, certificates and conformity declarations;
- production inspection records, batch or lot traceability and corrective actions.
Run a fresh review after any change to resin, paint, adhesive, magnet, battery, electronics, packaging or warning text.

Approve a pre-production sample (often called a golden sample) that matches the signed specification and test submission. Confirm dimensions, colors, materials, mechanisms, labels, warnings, packaging and instructions before authorising a pilot run.

- Inspect incoming materials and verify supplier certificates and lot identity.
- Observe the first articles and record process settings, assembly steps and deviations.
- Run the agreed functional, cosmetic and safety checks using defined acceptance limits.
- Use an independent or trained inspection process for production; document sample size, defects, rework and release decision.
- Retain production samples, test reports, invoices, shipping records and traceability data for the periods required in each market.
Stop and investigate a change or recurring defect rather than silently accepting a substitute. If a production change affects a tested characteristic, ask the laboratory or compliance adviser whether partial or full retesting is needed.
9. Package, launch and improve
Before committing inventory, verify that the package carries the required warnings, age grade, importer or responsible-person details, marks, instructions and disposal information for each destination. Photograph the actual production sample, set a channel-specific price that includes freight and compliance costs, and plan storage, fulfilment, returns and customer support.
Launch feedback is part of engineering. Track breakage, complaints, returns, retailer feedback and observed misuse by batch. Feed those findings into a controlled next revision rather than changing the product informally.
Plan the schedule and budget as stage gates
The Toy Association’s 2023 guide warns that the turnaround from an idea to toy retail shelves may exceed two years. Prototype iterations, tooling changes, failed safety tests, regulatory review, factory capacity, shipping and retailer calendars can extend it further.

Keep a contingency for redesign, retesting, shipping disruption and rejected units. Decide at each gate whether to proceed, revise, license the concept or stop before the next irreversible spend.
