Whether a teacher may wear a hijab at school depends on the country, the kind of school and the circumstances. In the United States, federal guidance distinguishes a teacher’s personal religious expression from religious activity conducted in an official role, while Title VII protects religious practices in employment and requires reasonable accommodation unless it causes undue hardship. In Germany, courts have rejected a general headscarf ban for state-school teachers, requiring evidence of a sufficiently specific danger before a restriction may be justified.
What a teacher’s hijab does—and does not—show
A hijab is a religious headscarf and a visible garment. Seeing a teacher wear one does not, by itself, establish the teacher’s reasons, level of religious observance, or personal history. Nor does wearing it alone mean the teacher is conducting religious instruction or endorsing a religion on behalf of the school.
That distinction matters in public schools: personal religious expression is not the same thing as a public official leading religious activity while acting in an official capacity. U.S. Department of Education guidance describes constitutional protection for private religious expression alongside limits on official school-sponsored religious activity.

Can a teacher wear a hijab in a U.S. school?
There is no single answer for every school and situation. U.S. Department of Education materials address religious expression in public schools; U.S. Department of Justice materials address employment discrimination and accommodation. The applicable rules can depend on whether the school is public or private and on the facts of the employment decision.
Public-school expression and official conduct
The Department of Education says public-school teachers and other officials acting in their official capacities may not lead classes in prayer or compel participation in religious activity. Its guidance also describes the Constitution as requiring neutrality toward religion—not hostility toward private religious expression. A teacher’s personal religious dress should not be conflated with leading prayer or requiring students to take part in religious activity.

Employment protections and accommodation
The Department of Justice states that Title VII applies to public and private employment, prohibits religious discrimination, and requires reasonable accommodation of religious practices unless accommodation would cause undue hardship. This federal summary does not decide how a particular workplace dispute should come out. As the DOJ Civil Rights Division puts it on its religious-discrimination page: “People should be hired or not hired because of their skills and merit, not because of their faith.”
What German courts have said about teachers’ headscarves
Germany’s rules arise from its own constitutional and employment-law framework; they are not a universal standard for other countries.

Federal Constitutional Court: 2015
In 2015, Germany’s Federal Constitutional Court ruled that a general headscarf ban for teachers at state schools was incompatible with the Constitution. It said an abstract danger to school peace or state neutrality was not enough: a restriction required a sufficiently specific danger.
Federal Labour Court: 2020 Berlin employment case
In 2020, the Federal Labour Court upheld compensation in a case involving a Berlin teacher applicant who wished to wear an Islamic headscarf while teaching. The state had not shown the concrete danger required to justify the restriction. The case concerned an employment dispute involving a teacher applicant, not a general ruling governing schools worldwide.

Why the Swiss teacher case is a separate example
The European Court of Human Rights case Dahlab v. Switzerland concerned a primary-school teacher who was prohibited from wearing an Islamic headscarf while teaching. It is a distinct teacher case in a different jurisdiction. It should not be treated as interchangeable with disputes about students’ clothing, or as a statement of the rules in the United States or Germany.

- Where is the school? The relevant country and local legal framework matter.
- What kind of school is it? Public- and private-school employment questions may involve different rules.
- What conduct is at issue? Personal religious dress is different from religious activity carried out in an official role.
- What justification and evidence are offered? In the cited German decisions, an abstract risk was insufficient; the courts required a sufficiently specific or concrete danger.
These examples do not provide a comprehensive survey of every country’s current law. The Department of Justice also recounts that Oregon repealed its public-school teacher religious-clothing ban in April 2010 after a federal civil-rights investigation; that is a historical example, not a statement of every state’s current law.
