Happy Birthday: What the Greeting Means and Where the Song Came From

“Happy birthday” is a straightforward wish. The familiar song has a separate history, with a melody linked to an 1893 song and a U.S. copyright dispute over its lyrics.

“Happy birthday” is a simple wish for someone celebrating their birthday. You can say it, write it in a card, or sing the familiar song; the greeting does not require the song.

What does “happy birthday” mean?

It is a customary way to offer good wishes to someone on the anniversary of their birth. The words work as a spoken greeting or a written message. A birthday card is one direct way to send that wish; the message can be brief or personal.

Where did the “Happy Birthday to You” song come from?

The familiar song uses a melody associated with “Good Morning to You,” which appeared in the 1893 songbook Song Stories for the Kindergarten. In its February 17, 2016 account, the World Intellectual Property Organization (WIPO) identifies Mildred Hill as composer of the melody and Patty Hill as writer of the original “Good Morning” lyrics.

The birthday words came later. WIPO reports that the full birthday lyrics appeared in print in a 1911 book for elementary teachers, but that the book did not identify their author. Later publications also failed to establish authorship reliably. The available evidence therefore does not support presenting Patty Hill as the confirmed author of the birthday lyrics.

Is “Happy Birthday to You” copyrighted?

The answer depends on which material, country, and legal rights are meant. In the U.S. dispute over Warner/Chappell’s claim to the lyrics, a federal district judge ruled on September 22, 2015, that the registration Warner/Chappell relied on did not cover the birthday lyrics. The court also found insufficient evidence that the Hill sisters had transferred common-law rights in those lyrics to Summy Co. On that record, Warner/Chappell had no enforceable copyright in the lyrics.

WIPO’s 2016 article reported that the melody’s copyright had expired in 1949 and that Warner/Chappell’s claim at issue concerned the lyrics. It also described a proposed settlement involving refunds of up to USD 14 million to eligible class members, with court approval then scheduled for March 14, 2016. Those are figures and procedural details from a historical report, not current prices or a statement of the present status of every version, arrangement, recording, or jurisdiction.

For a specific use, such as putting the song in a film or using a particular recording, the 2015 U.S. ruling should not be treated as a universal clearance. The ruling addressed the claim and evidence before that court; it does not by itself resolve rights in every arrangement or recording around the world.

Why is the greeting associated with a song and a card?

The greeting can stand on its own, while singing it is a familiar birthday ritual, often as a cake with candles is presented. A card offers a written way to convey the same wish. The Smithsonian’s account of American birthday celebrations includes cards among the products associated with those celebrations.
