A real photograph—not an AI-generated image—won third place and the People’s Vote in an AI category before being disqualified. Miles Astray’s surreal flamingo picture looked synthetic because the bird had tucked its head behind its body. Its unusual appearance exposed the gap between what an image looks like, how it was made, and whether it is eligible for a particular contest category.
It was a real photograph—not an AI-generated image. In June 2024, photographer and writer Miles Astray entered his photograph F L A M I N G O N E in the artificial-intelligence category of the 1839 Awards’ 2024 Color Photography Contest. The image showed a flamingo on an Aruba beach with its head tucked behind its body, making the bird look almost headless and the scene look strangely synthetic.
The photograph received the category’s Bronze award—described in reports as third place—and also won the category’s People’s Vote Award. Astray then revealed that he had taken the image himself. The 1839 Awards disqualified it, not because the photograph was fake, but because it did not meet the AI category’s eligibility rules.
What happened to the “headless flamingo” photograph?
Astray photographed the flamingo in Aruba in 2022. He later submitted the image to the AI category as a deliberate reversal of a trend that had already unsettled photography competitions: AI-generated pictures appearing in contests intended for human-made photography or art.

His photograph went in the opposite direction. It was made with a camera, but its improbable composition looked like something a generative image system might invent: a pink bird with no visible head or neck, an unusually shaped body, and a minimal pale background.
The image was accepted, selected for the Bronze award, and voted the public favorite in its category. According to CBS’s reporting, Astray learned of the recognition on June 11, 2024, disclosed the image’s origin shortly afterward, and saw the award rescinded on June 12. The 1839 Awards published its explanation on June 13.

How was the photograph made?
Astray took the picture during an early visit to a beach known for its flamingos. By his account, the bird was scratching or cleaning its belly. That movement placed the flamingo’s head and neck behind its body, leaving a silhouette that looked anatomically impossible at first glance.

The bird was alive and simply positioned in an unusually misleading way.
The available reporting does not establish the camera model, lens, exposure settings, RAW-file history, or complete post-processing workflow. Those details should not be inferred from the image or added to the story. What is established is narrower and more important: Astray photographed the scene in Aruba in 2022, and the picture was not generated by an AI system.

Why did he enter a real photo in an AI category?
Astray’s submission was intended as a visual and institutional experiment. Earlier controversies had involved AI-generated images entering conventional photography or art competitions. He wanted to reverse the situation: place a human-made photograph in a category created for synthetic imagery and see whether its appearance would fit the expectations of judges and voters.
His point was not that one flamingo picture proves humans are better than AI at making images. Nor was it evidence that AI cannot create compelling or photorealistic work. Astray acknowledged that generated images have advanced to the point where some can be difficult to distinguish from photographs.

A real animal in a fleeting posture can generate the same reaction that viewers often have to synthetic imagery: that cannot be real.
Why did the judges and voters accept it?
No source reviewed establishes that the jury used a particular AI detector, inspected a specific file characteristic, or failed because of a known technical flaw. It would be inaccurate to claim that the photograph “fooled an AI detector” when the available accounts do not show that such a tool was used.
The more defensible explanation is contextual. The organizers and judges had no obvious reason to expect someone to submit an ordinary camera photograph to an AI-only category. The image also visually matched the category’s assumptions. Once viewers accepted that the entry was supposed to be AI-generated, its unusual shape could be interpreted as evidence of synthesis rather than as an especially strange moment in the natural world.

CBS quoted Lily Fierman, a director and co-founder of Creative Resource Collective, saying that the organizers had not expected a participant to submit a non-AI image to the category. That supports an explanation based on expectations and category context—not a claim about a specific detection failure.

Untrained viewers can struggle to distinguish AI-generated images from authentic photographs, particularly when the photograph itself contains an unusual pose, ambiguous anatomy, or a surreal-looking composition. Conversely, an AI image can look entirely ordinary. Visual plausibility alone is an unreliable substitute for provenance.
Why was the photograph disqualified?
The 1839 Awards’ position was effectively: the image was real, but it was in the wrong category.
The contest said its standalone AI category was intended for artists working with the new medium. Its current Color Photography Contest information states that AI-generated images are admissible only in a designated AI category when a contest provides one. Under that framework, an authentic camera photograph does not become eligible for the AI category simply because it resembles an AI image.
That distinction matters. The disqualification was an eligibility decision, not a finding that Astray had fabricated the photograph or misrepresented a synthetic image as a camera original. The work passed the category’s apparent visual test, received recognition, and was later removed after its provenance became known.

The contest nevertheless acknowledged the point behind the stunt and said it appreciated Astray’s message. Its response separated two questions that are often collapsed in debates about AI art:
- Is the image authentic? Astray’s photograph was a genuine photograph.
- Does the image belong in this category? The contest decided that it did not.
What this incident says about photography and AI art
The most useful lesson is about boundaries and trust, not about a final contest between humans and machines.
Appearance does not establish provenance
The flamingo looked synthetic because the moment was visually strange. That tells us something about perception, but not about how the file was made. A picture’s appearance can prompt questions about provenance; it cannot answer them on its own.
Category rules are part of the artwork’s context
The same image can be discussed as photography, conceptual art, or commentary on AI depending on the setting. But contests still need operational rules. If an AI category is reserved for AI-generated work, a human-made image remains ineligible even when it makes a powerful statement about AI.
Disclosure protects the meaning of the result
For photographers and artists entering competitions, the important information is not only what the finished image looks like. It can also include how it was captured, whether generative tools were used, what edits were made, and what the contest’s rules permit. When a category depends on process, disclosure is part of the submission—not an optional footnote.

The photograph did not prove that humans are superior to AI
It would overstate the incident to call it proof that a human “beat AI.” The image was not competing against a defined AI system under controlled conditions, and the result does not show that human-made images are always more creative or more difficult to identify.
What it did show is more specific: a real photograph could look sufficiently AI-like to win a jury prize and a public vote in a category intended for generated imagery. That is a meaningful warning about how quickly viewers attach a label to visual strangeness.
What photographers should check before entering an AI-related contest
The episode offers a practical checklist for anyone submitting work to a competition with AI rules:
- Read the category definition. Determine whether “AI” means fully generated images, images made with specified tools, or photographs that may include generative edits.
- Check the process requirements. Some contests may ask for prompts, source images, process records, layered files, or camera originals.
- Disclose assistance and editing. Do not assume that a minor generative edit is treated like ordinary retouching.
- Keep supporting records. Preserve original files and relevant editing history where the rules make provenance material.
- Ask the organizer before submitting an ambiguous work. A photograph made as commentary on AI may still be ineligible for an AI-only category.
For organizers, the lesson is similar: define eligibility in terms of process and provenance, explain what evidence may be requested, and avoid relying on visual impressions as the entire verification system. A detector may be part of a review process, but the available reporting on Astray’s case does not establish that a detector was involved.
