Not exactly. On August 30, 2025, a judge found no probable cause for Orestes Sebastian Suarez’s arrest over chalk marks near Orlando’s Pulse memorial crosswalk and released him on his own recognizance. That was not a final ruling that chalking was legal or a documented permanent dismissal. In April 2026, prosecutors separately said they would file no charges against six people arrested in related incidents.
The headline is misleading if it suggests that a Florida judge finally dismissed a case or ruled that chalking a roadway is legal. On August 30, 2025, a judge found no probable cause for Orestes Sebastian Suarez’s arrest and released him on his own recognizance. That was an initial-appearance ruling—not a finding that Suarez was innocent, not a ruling on the First Amendment, and not a final adjudication of whether chalking the crosswalk was lawful.
The broader controversy continued after Suarez’s release. Florida Highway Patrol arrested Suarez on Friday night, August 29, 2025, during a protest near the rainbow memorial crosswalk outside the former Pulse nightclub site in Orlando. According to contemporary reporting, Suarez put chalk on the bottom of his shoe and walked across the roadway, leaving chalky footprints on the crosswalk. At Suarez’s initial appearance the next day, the judge found no probable cause for the arrest and ordered him released on his own recognizance.[C1] The ruling addressed whether the arrest could be supported at that stage of the proceeding. It did not conclusively decide whether Suarez had committed criminal mischief, whether the crosswalk legally qualified as an official traffic-control device for these purposes, or whether his conduct was protected expressive activity.

The statute makes violations punishable under Florida’s criminal-mischief law.[C5]
Section 806.13 generally defines criminal mischief as willfully and maliciously injuring or damaging another person’s property. The offense can become more serious when the applicable statutory conditions are met and the damage reaches $1,000 or more; a qualifying amount at that level can constitute a third-degree felony.[C6] The reported dollar figure in the related arrests therefore mattered, but a claimed cleanup bill was not automatically the same thing as legally provable property damage.

The legal questions were more complicated than “Was there chalk?”
The state’s theory required more than proof that a temporary mark appeared on pavement. The important questions included:
- What was the legal object? Prosecutors would need to connect the alleged conduct to an official traffic-control device, its marking, or a related inscription or component—not merely to a generic piece of pavement.
- What did the chalk do? The case depended on whether placing chalk on the crosswalk amounted to prohibited alteration, defacement, injury, or damage under the relevant statutes.
- Was there lawful authority? Permission, government authorization, or another legally relevant form of authority could affect the analysis.
- Was the conduct willful and malicious? Those concepts belong to the criminal-mischief statute and are separate from proving that a mark was visible.
- What was the actual damage? A cost estimate for labor or cleaning does not necessarily establish permanent property damage of at least $1,000.
- Was the activity expressive conduct? Because the chalking occurred during a protest and involved a memorial crosswalk, constitutional and free-expression issues were part of the public debate. The sources reviewed do not show that the judge resolved those issues in Suarez’s initial-appearance hearing.
There is no controlling appellate decision identified in the research that resolves these precise facts: temporary chalk on a memorial crosswalk, a traffic-control-device charge, claimed restoration costs, and protest-related expression. The safest conclusion is that the case raised those questions without producing a broad judicial ruling on chalk art or First Amendment rights.
Why the Pulse crosswalk mattered
The location carried significance beyond its traffic function. The rainbow-colored crosswalk outside the former Pulse nightclub site had been installed in 2017 and served as a memorial to the 49 people killed in the June 12, 2016, Pulse nightclub shooting.[C7]
Florida’s removal of the rainbow coloring in 2025 turned a roadway-maintenance dispute into a political and cultural conflict. The Associated Press reported that FDOT circulated a June 2025 memo prohibiting “surface art” associated with social, political, or ideological messages on crosswalks, sidewalks, intersections, travel lanes, and shoulders. After the original colors were removed, some residents attempted to restore them with chalk; rain washed away portions of the markings.[C7]

Orlando officials and LGBTQ advocates characterized the removal as an attack on a memorial and on LGBTQ visibility. State officials presented it as enforcement of roadway-marking and traffic-safety rules. Those are competing political interpretations, not findings made by the judge in Suarez’s hearing. A careful account should attribute them rather than state either interpretation as an established legal fact.

What FDOT says pavement markings are for
FDOT’s public pavement-marking materials explain that roadway markings communicate lane boundaries, turning guidance, crosswalk locations, and warnings. Florida’s standards draw on the federal Manual on Uniform Traffic Control Devices.[C8] That supports the agency’s general argument that pavement markings are regulated transportation infrastructure rather than unrestricted public art space.
But transportation guidance does not automatically prove every element of a criminal case. The existence of standards for crosswalk markings does not, by itself, establish that every temporary expressive mark constitutes criminal damage. The prosecution would still have to prove the statutory elements and overcome any relevant authorization, evidentiary, or constitutional issues.
What happened in the related arrests?
Suarez’s release did not end the chalking controversy. WESH reported that three additional protesters were arrested on August 31, 2025. Their arrest documents cited chalking on the crosswalk and alleged restoration costs of approximately $1,562.[C2] Other arrests followed in later months, including arrests reported in November 2025.[C3]
On April 24, 2026, State Attorney Monique Worrell announced that her office would not file charges against six people arrested in connection with the chalking incidents.[C3][C9] Reporting on the decision said prosecutors could not meet the legal burden needed to proceed, particularly because they could not prove actual property damage of at least $1,000. The office viewed the reported cleaning labor and equipment costs as insufficient to establish permanent property damage when the material was water soluble and designed to wash away.[C9]

That decision is more definitive than Suarez’s initial-appearance release in one respect: the prosecutor announced that six related cases would not be charged. But it still should not be inflated into a declaration that all chalking on public roadways is lawful. Worrell framed the decision around the evidence and legal burden in those cases. A prosecutor’s decision not to file charges is also different from an appellate court’s ruling establishing a statewide legal rule.

What this means for artists and protesters
The practical lesson is not that temporary materials are automatically safe, nor that a roadway marking is automatically protected public art. Location, authorization, the object marked, the government’s damage evidence, and the expressive context can all matter.
Artists considering work in public spaces should distinguish between a designated art area and transportation infrastructure. Before marking a crosswalk, sidewalk within a state right-of-way, travel lane, or other regulated surface, obtain clear permission from the responsible property or transportation authority. A medium that washes away may reduce restoration concerns, but it does not necessarily eliminate traffic, trespass, vandalism, or other legal risks. Protesters should also avoid obstructing traffic and should understand that an arrest can occur even when prosecutors later conclude that the evidence is insufficient to file charges.
For the Pulse crosswalk specifically, the memorial meaning explains why participants viewed the chalking as expressive restoration rather than ordinary vandalism. It does not, by itself, answer the statutory questions. Conversely, the state’s authority to regulate roadway markings does not by itself prove the criminal case. The August 2025 hearing and the April 2026 charging decision illustrate that distinction.
