Midjourney is a subscription-based generative-AI service that creates images—and, in its current documentation, videos—from text prompts and optional image references. You can use it through the Midjourney website or Discord to explore concepts, generate illustrations, develop characters, create mood boards, and produce visual variations.

The important legal distinction is easy to miss: Midjourney’s terms may give you contractual permission to use an asset, but that does not guarantee copyright protection, exclusivity, privacy, or freedom from third-party claims. Those are separate questions.

Midjourney is a generative-AI image service. You describe an intended image in ordinary language, and its trained model produces visual candidates based on that description. You can then select, vary, edit, reference, upscale, download, or share a result.

Midjourney is available through its website and Discord. Its current documentation identifies V8.1 as live, with features including image prompts, a prompt-shortening tool, an updated Describe tool, and optional 2K HD output using --hd. Some tools remain tied to earlier versions: for example, the documentation says V8.1 images can be used in the Editor while Editor functionality is currently using V6.1. Features and labels can change quickly.
Unlike Photoshop, Procreate, or Affinity, Midjourney is primarily a synthesis tool rather than a conventional canvas-based editor. Unlike a stock library, it generates new results instead of offering a fixed catalogue. Unlike image search, it does not simply retrieve one matching photograph, although an output can still resemble existing visual ideas, characters, brands, or artwork.
What can Midjourney create?
Common uses include:
- Concept art for characters, environments, interiors, products, and architecture
- Editorial illustrations and book or game-development references
- Mood boards, storyboards, and visual development work
- Marketing concepts, packaging ideas, and social-media graphics
- Fashion, interior, and architectural visualisation
- Image variations and style exploration
- Video generation, subject to the current model, plan, and feature limitations
It is especially useful when you need many visual directions quickly. It is less reliable when the result must contain accurate lettering, exact product details, consistent characters, or factual information.

Typical problems include garbled text, distorted hands or faces, incorrect object counts, inconsistent perspective, implausible spatial relationships, and attractive but false historical, scientific, medical, or news-related details. Outputs can also be too similar to recognisable characters, logos, brands, celebrities, or existing artwork.
How does Midjourney work?
Midjourney does not publicly document every architectural detail of its models, training pipeline, model weights, or inference process. A safe high-level explanation is:
- You submit a text prompt and, optionally, image references.
- The model interprets relationships between words, visual concepts, composition, lighting, and appearance.
- It generates candidate compositions rather than following a perfectly deterministic command.
- You choose a result and refine it with variations, references, editing, or upscaling.
- You download, share, or incorporate the result into a larger human-created work.
The process is probabilistic. Similar instructions can produce different results, and a prompt alone does not provide pixel-level control over the final image.
Prompts, references, and parameters
A text prompt describes the subject, setting, composition, lighting, mood, medium, or visual direction. An image prompt supplies visual guidance. A Style Reference is intended to influence visual appearance, while an Omni Reference can help carry a character or object into another generation. Parameters provide additional controls.

A useful beginner structure is:

Seeds or repeatability controls may help with consistency where available, but reproducibility is not absolute. Upscaling enlarges or refines a selected result; it is not necessarily the same as generating a wholly new composition.
How to make your first Midjourney image
- Create or log in to a Midjourney account.
- Subscribe to a plan.
- Open the web Create page.
- Enter a description in the Imagine bar.
- Review the generated candidates.
- Use variation, reference, editing, or upscale controls to develop the preferred result.
- Download it from the image or organisation interface.
Discord is still an alternative interface, but it should not be presented as the only current workflow. Midjourney’s account documentation says current plans support both the website and Discord.
If the first result is unusable
- Too many competing details: simplify the prompt and identify one primary subject.
- Wrong objects or clutter: use
--noand generate several candidates. - Bad lettering: add text manually in a conventional graphics editor rather than relying on generated typography.
- Inconsistent characters: maintain a prompt and reference library, use current reference tools, and expect manual cleanup or compositing.
- Brand-critical imagery: treat Midjourney as a concept generator and rebuild or correct key elements yourself.
Midjourney plans and pricing
The following prices were displayed in Midjourney’s official plan documentation in August 2026. Prices, limits, included features, and availability may change.

Midjourney says annual billing is 20% cheaper when paid upfront, and lists extra GPU time at $4 per hour. Unused Fast time does not carry over. Plans automatically renew unless cancelled; downgrades generally take effect at the next renewal. Midjourney’s billing documentation says refunds are available only when an account has used less than 20 GPU minutes over its lifetime, subject to the applicable process.
For most individuals, Basic suits occasional use and Standard suits frequent image generation when Relax mode is adequate. Pro is the practical choice when Stealth and greater capacity matter. Mega is aimed at heavy individual production and higher concurrency.
Do not assume Basic or Standard are noncommercial plans. The significant commercial restriction concerns companies or employees of companies exceeding $1 million in annual gross revenue: under Midjourney’s terms, they must use Pro or Mega to own their assets.

Can you use Midjourney images commercially?
Midjourney’s terms say users own assets they create to the fullest extent possible under applicable law, subject to third-party rights and the agreement. Its commercial-use guidance also states that companies or employees of companies making more than $1 million in annual gross revenue must use Pro or Mega to own assets.

It is not an indemnity, originality guarantee, or promise that nobody else has a similar output.
There is a particularly important exception: if you upscale an image originally created by another Midjourney user, the upscale remains owned by the original creator. Upscaling or modifying another user’s result does not automatically make it yours.
Commercial-use checklist
- Check whether your company’s annual gross revenue requires Pro or Mega.
- Ask the client whether generative AI is permitted.
- Do not upload confidential client material without authorisation.
- Check for logos, characters, celebrity likenesses, private people, and recognisable third-party designs.
- Keep prompts, references, edits, source files, and compositing records.
- Correct text, factual details, and brand-critical elements manually.
- Disclose AI assistance where a contract, client, platform, or professional rule requires it.
- Obtain legal review for valuable, highly visible, or brand-critical work.
Who owns Midjourney images?
There are three different questions:
- What does Midjourney’s contract say? It says the user owns created assets as far as applicable law permits.
- What does copyright law protect? That depends on the jurisdiction and on the human creative contribution.
- Could someone else have rights in the input or output? Yes. Third-party photographs, artwork, characters, trademarks, likenesses, and confidential material can create separate issues.
Midjourney’s terms say users retain ownership after downgrading or cancelling, but also place responsibility on users for content they provide or generate. The contract cannot override another person’s copyright, trademark, privacy, publicity, or confidentiality rights.
Are Midjourney images copyrighted?
Not automatically. In the United States, the Copyright Office’s position is based on human authorship. Material generated without sufficient human authorship is not protected merely because a person typed a prompt.

Human selection, arrangement, editing, compositing, or modification may be protectable. Protection generally applies to the human-authored contribution, not automatically to every underlying AI-generated pixel. There is no universal safe number of prompt words or editing minutes; the nature and extent of human control matter.
In its analysis of Zarya of the Dawn, the U.S. Copyright Office concluded that the Midjourney-generated images themselves were not human-authored images, while human-authored portions and the arrangement of the work could receive protection. The Office’s broader AI initiative provides current guidance and policy material.

A more accurate summary than “AI art cannot be copyrighted” is:
A purely AI-generated image may lack copyright protection in the United States, while a sufficiently human-authored composition or materially edited image may contain protectable human-authored elements.

Copyright rules vary by country. If registration or exclusivity matters, preserve your creative-process records and speak with an intellectual-property lawyer about the law where you will publish or enforce the work.
Registration and disclosure
For a U.S. registration involving AI-assisted material, an applicant may need to identify AI-generated content, exclude material lacking human authorship, and describe the human-authored portions. Keep prompts, iterations, edits, layered files, sketches, compositing records, and other evidence of your contribution.

Midjourney’s AB2013 documentation, updated January 20, 2026, says its training data includes a mixture of licensed data, public-domain data, internally generated and synthetic data, data not eligible for copyright protection, and data that may be copyright-protected and used under a fair-use theory.
The disclosure describes training as teaching visual patterns, artistic styles, and relationships between visual characteristics and textual descriptions. It does not, by itself, establish that all training uses are lawful or unlawful. Whether a particular practice infringes copyright is a legal and factual question.

Main risks and limitations
Third-party intellectual-property rights
Using an artist’s name, a copyrighted character, a trademarked logo, a celebrity likeness, or another person’s photograph can create legal and ethical risk. “In the style of” requests are not automatically legal or illegal in every jurisdiction; the risk depends on the circumstances, the resulting image, the artist’s rights, and how the work is used.
Be especially careful with:
- Photographs you did not create or license
- Client images and unreleased product designs
- Living artists’ distinctive styles in commercial campaigns
- Recognisable celebrities or private individuals
- Brand logos, uniforms, characters, and product designs
- Images that imply endorsement or sponsorship
Privacy and public visibility
Midjourney operates as an open community by default. Content posted in public settings can be visible and remixable. A shared Discord room can expose an image to everyone in that room even if you have enabled other privacy-related features.
Stealth mode is available only on Pro and Mega. Midjourney says it will make best efforts not to publish assets created while Stealth is engaged, but that is not the same as a universal confidentiality guarantee. Do not treat a Basic or Standard subscription as suitable for trade secrets, unreleased campaigns, private photographs, or confidential client work without checking the current terms and obligations.
Automation and production pipelines
Midjourney’s Community Guidelines state that, except for limited expressly permitted cases, it does not provide a general API and prohibits third-party apps, scripts, and automated interaction with the service. That makes it a poor fit for developers who need a conventional image-generation API or automated high-volume pipeline. Use a provider that officially supports the required API and commercial workflow instead of attempting to automate Midjourney against its rules.
Accuracy and consistency
Midjourney can produce persuasive images containing false details. It may also struggle with exact typography, repeatable characters, technical diagrams, product accuracy, and pixel-perfect brand compliance. For those jobs, use it for ideation and then rebuild, edit, verify, or composite the final work with human-controlled tools.
Is Midjourney suitable for professional work?

Pro and Mega improve privacy and capacity. They do not eliminate copyright uncertainty, guarantee non-infringement, or provide automatic legal exclusivity.
Alternatives to Midjourney
The right alternative depends on the workflow rather than image quality alone:
- Adobe Firefly may suit users already working in Photoshop and other Adobe tools who want integrated editing.
- Canva may suit marketers, educators, and small businesses creating images inside a broader publishing platform.
- OpenAI image generation may suit users who want conversational planning, revisions, and image editing; access and terms vary by product and plan.
- The Stable Diffusion ecosystem may suit technical users who need more control, customisation, or local and hosted deployment options, but model licences and setup requirements differ.
Before choosing, compare current commercial-use terms, privacy defaults, API availability, enterprise administration, editing control, text rendering, reference tools, output limits, indemnity language, refund rules, and geographic restrictions. Do not assume one provider’s terms apply to another’s models or plans.
Bottom line
Midjourney is a powerful tool for visual ideation, stylised imagery, image variations, and increasingly video. It can save substantial time for artists, authors, marketers, designers, and developers—but it is not a substitute for factual review, manual art direction, rights clearance, or legal judgment.
The safest way to think about a Midjourney image is: commercially usable under the platform’s terms may not mean exclusively copyrightable, private, original, or free of third-party claims. Check the plan, protect confidential material, keep records of your human contribution, verify the output, and obtain legal advice when the project’s value or risk justifies it.
